Article 1 These Provisions are formulated in order to deepen the reform of the management system of the construction industry, improve the management of tendering and bidding in the construction market and general contracting of projects, and do a good job in contracting construction projects. Second departments and units (including railway, military and other professional departments) must enter the municipal bidding market in accordance with the unified provisions of the municipal government, and the municipal bidding management office will organize public bidding. It is not allowed to set up another standard or institution to illegally trade outside the market. Article 3 In the bid evaluation and calibration, if two or more enterprises win the bid at the same time, the construction contractor shall be determined by public lottery or lottery under the supervision of the bid evaluation team and presided over by the staff of the Municipal Bidding Office. Once confirmed, no unit or individual may change it at will. If the scoring method is adopted, the construction contractor shall be determined according to the highest score after scoring by the bid evaluation team. The bid evaluation and calibration of large and medium-sized and key projects shall be the responsibility of the Municipal Bid Evaluation Committee. Article 4 No unit or individual may engage in "fake bidding" or "fake bidding" in private, and may not hold "one-on-one" or "hand in hand" bid negotiation under any pretext. Once found, the bidder will be disqualified for half a year to one year, and the construction unit will be fined 0.5% to 1% of the project cost depending on the seriousness of the case. Article 5 A construction unit shall not demand property under any pretext, nor threaten the construction unit with conditions such as traveling or visiting. The construction unit shall not give kickbacks to the construction unit in the name of bonuses, subsidies and commissions. In case of violation of this regulation, the contract relationship of Party A and Party B shall be terminated immediately, and both parties shall be given economic penalties and administrative sanctions; If a crime is constituted, it shall be dealt with by judicial organs. Article 6 A bid inviting unit that is unable to prepare the pre-tender estimate shall prepare the pre-tender estimate at a consulting institution with legal person qualification, and shall be subject to the examination of the local Construction Bank and the bidding market management department as required. Article 7 The following acts of the construction unit are strictly prohibited: (1) Depressing the contract price. (2) making things difficult for the contractor by means of advance payment. (three) the cost of dead projects is not arbitrarily increased according to the policy. (four) the construction funds of contracted projects are not implemented. Article 8 The construction unit shall not hand over the proposed project to the "intermediary" for contracting out, and shall not resell the project by the "intermediary". In case of violation, the following penalties will be given: (1) contract relationship will be dismissed; (two) to impose a fine on the construction unit, the construction unit and the "middleman"; (three) to stop the bidding qualification of the construction unit. Article 9 Construction and installation enterprises shall not engage in the following acts: (1) Subcontracting contracted projects at different levels. (2) reselling the project in the name of subcontracting. (3) Level-III enterprises will subcontract the labor services outsourced. Article 10 The bidding sub-market approved by the municipal bidding leading group must accept the unified organization, supervision and management of the municipal bidding management office. Article 11 The staff of government departments and management agencies responsible for contracting projects shall not abuse power for personal gain. Other departments or staff members shall not use their powerful authority to recommend the construction unit by the bidding unit and interfere in the bidding work; It is not allowed to accept kickbacks, handling fees and hard work fees in various names. If there is any violation, it will be handled by the supervision department. Twelfth City Construction Management Bureau and the Construction Committee, industry and commerce, China Construction Bank and other departments should strengthen management and mutual supervision to ensure the smooth progress of construction projects. Thirteenth these Provisions shall come into force as of the date of promulgation.
