Highway, port and shipping, highway transportation and quality supervision and management institutions established by transportation departments at or above the county level shall be responsible for the specific management of traffic construction within their respective functions and duties.
Development planning, construction, price, finance, land and resources, auditing and other departments at or above the county level shall, in accordance with their respective responsibilities, carry out traffic construction-related management. Article 4 Traffic construction shall be based on the needs of national economic and social development, with overall planning, rational layout, land conservation, environmental protection, strict implementation of capital construction procedures and quality standards, and adherence to and maintenance of traffic construction market order.
Encourage the use of advanced technology, equipment, technology, new building materials and advanced management methods to improve the quality of traffic construction. Fifth people's governments at all levels should take measures to support, protect and promote the development of traffic construction, implement the target responsibility system for traffic construction and development, and do a good job in organizing and coordinating land acquisition, demolition and compensation. The specific compensation standards for land acquisition and demolition shall be formulated by the people's governments at or above the county level in accordance with the management authority. Seventh to enter the traffic construction market, the legal person and business unit of traffic construction projects must meet the market access conditions stipulated by the state.
Project legal person refers to a legal person who enjoys the right to operate traffic construction projects and undertakes corresponding obligations.
Business units refer to units and social intermediary institutions engaged in traffic survey and design, consultation, construction, supervision and testing. Article 8 A project legal person entering the traffic construction market must meet the following conditions:
(1) Obtaining the qualification of project legal person according to law;
(two) there are organizations, technical and financial management personnel and corresponding institutions suitable for the scale of the proposed project;
(three) have the corresponding project planning, fund raising and construction project management capabilities; Legal persons engaged in traffic construction projects should also have corresponding management, debt repayment and asset management capabilities. Article 9 A business unit entering the traffic construction market must meet the following conditions:
(1) Having a business license to engage in the business scope of traffic construction;
(two) the qualification certificate of the construction enterprise with the corresponding grade;
(3) Having good traffic construction performance and reputation;
(4) Having corresponding personnel, equipment and funds.
It is forbidden to contract out traffic construction projects to business units that do not meet the above conditions. Tenth traffic construction must adhere to the principle of first survey, then design and then construction, and it is strictly forbidden to survey, design and construct at the same time. Traffic construction procedures shall be carried out in accordance with the following provisions:
(a) Conduct a preliminary feasibility study and complete a project proposal;
(two) to carry out the feasibility study of the project and prepare the feasibility study report of the project;
(3) Preparation of preliminary design documents and construction drawing design documents;
(four) to complete the project bidding documents and organize the project bidding;
(five) to prepare and complete the project commencement report and organize the project implementation;
(6) Handling project acceptance and organizing post-project evaluation.
If the state has other provisions on traffic construction procedures, those provisions shall prevail. Article 11 The project proposal, feasibility study report and preliminary design of self-financing traffic construction projects within the limits stipulated by the provincial people's government shall be examined and approved by the provincial department in charge of transportation and reported to the provincial development planning department for the record. The examination and approval of other traffic construction projects shall be carried out in accordance with the relevant provisions of the state and provincial people's governments. Article 12 The bid evaluation of traffic construction projects shall be undertaken by the bid evaluation committee established by the tenderer according to law. The experts of the bid evaluation committee shall be randomly selected from the expert database established by the national or provincial transportation authorities. The tenderer shall determine the winning bidder according to the written bid evaluation report put forward by the bid evaluation committee and the recommended candidate winning bidders.
It is forbidden to subcontract or illegally subcontract in traffic construction. Thirteenth applications for traffic construction projects must meet the following conditions:
(a) the project legal person has been established;
(2) The preliminary design and general budget of the project have been approved;
(three) the project funds have been implemented;
(four) the construction drawing can meet the needs of continuous construction;
(five) the land examination and approval procedures have been completed, and the land acquisition and demolition work has been basically completed;
(six) the construction and supervision contract has been signed;
(seven) the project quality supervision and environmental protection measures have been implemented.
If the above commencement conditions are met, the transportation department shall give a reply within 15 days from the date of receiving the commencement report. Fourteenth traffic construction project quality responsibility system. The project legal person is fully responsible for the project quality. Survey and design units are responsible for the quality of survey and design. The construction unit is responsible for the construction quality. The supervision unit undertakes the supervision responsibility. The traffic administrative department and other relevant administrative departments shall bear the responsibility of supervision.
