Article 2 The term "environmental noise" as mentioned in this Law refers to the noise produced in industrial production, construction, transportation and Sounds produced in social life that interfere with the surrounding living environment. ?The term "environmental noise pollution" as used in this Law refers to the phenomenon that the environmental noise generated exceeds the environmental noise emission standards prescribed by the state and interferes with the normal life, work and study of others. Article 61 Units and individuals harmed by environmental noise pollution have the right to require the perpetrators to eliminate the harm; if losses are caused, they shall compensate for the losses in accordance with the law.
Disputes over liability for compensation and the amount of compensation may, at the request of the parties, be mediated by the environmental protection administrative department or other supervisory and administrative departments or institutions responsible for the prevention and control of environmental noise pollution; if mediation fails, the parties may submit Prosecution in the People's Court. The parties may also file a lawsuit directly with the People's Court. Article 62 If personnel who supervise and manage environmental noise pollution prevention and control abuse their power, neglect their duties, or practice favoritism for personal gain, they shall be subject to administrative sanctions by their unit or the superior authority; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
Regulations of the People's Republic of China on the Prevention and Control of Environmental Noise Pollution
Article 34 Operators of entertainment and sports venues shall take effective measures to reduce or eliminate noise impact on the surrounding environment. Article 35 When using household appliances, musical instruments and carrying out entertainment activities indoors, the volume should be controlled and no interference should be allowed to others. Article 38 Anyone who violates the provisions of these regulations and commits any of the following acts shall be punished by the public security department in accordance with the "Regulations on Public Security Administration and Penalties of the People's Republic of China": Those who emit noise that seriously disturbs others from indoors or in public areas ; Article 40 For enterprises and institutions that fail to complete the rectification tasks within the prescribed time limit, in addition to charging excessive sewage discharge fees in accordance with national regulations, they may be fined based on the harmful consequences caused, or ordered to suspend operations or close down. Fines shall be determined by the environmental protection department or other supervision and management departments. Orders to suspend business or close down shall be decided by the people's government that makes the decision on rectification within a time limit. However, ordering enterprises and institutions under the direct jurisdiction of the relevant departments of the State Council to suspend business or close must be submitted to the department for approval. Article 43 Units and individuals that cause environmental noise pollution have the responsibility to eliminate the harm and compensate the organizations or individuals who directly suffered damage.
