The district people's governments and the relevant administrative departments of municipal construction, planning, urban management, public security and fire protection, civil air defense, environmental protection, heating, health, radio and television, water affairs, etc. shall, according to their respective functions and duties, do a good job in the management of the delivery and use of new houses. Article 6 A newly-built house shall meet the following conditions before it can be delivered for use:
(a) the main project and supporting facilities construction meet the planning requirements, and the acceptance;
(2) The survey, design, construction and supervision of the project conform to the provisions of laws, regulations and national mandatory standards, and the project is qualified after completion and acceptance, and shall be filed with the construction administrative department;
(3) Environmental protection facilities have been completed and passed the acceptance of environmental protection departments;
(four) domestic water facilities and water quality meet the relevant standards of sanitation and water saving, and the use of urban public water supply is included in the urban public water supply pipe network and officially supplied;
(five) the drainage facilities meet the relevant standards and pass the acceptance, and the rain sewage discharge is included in the urban rain sewage discharge system;
(six) electric power into the city power supply network, and formal power supply;
(seven) the heating system conforms to the standard of heating distribution, and the use of urban central heating is included in the urban central heating pipe network;
(eight) to complete the laying of indoor gas pipelines and the connection of outdoor gas pipelines to ensure gas supply;
(nine) telephone communication lines and cable TV lines are laid to households, and cable TV lines are included in the municipal regional cable TV network;
(ten) the greening of courtyards, roads and other supporting facilities meets the design requirements and has passed the acceptance;
(eleven) the courtyard is clean and flat, delivered by stages, and effective measures are taken to isolate it from the construction site;
(twelve) has hired the prophase property management enterprise, and go through the formalities of property acceptance;
(thirteen) the relevant public service houses and supporting facilities shall meet the design requirements and go through the acceptance procedures;
(fourteen) the demolition and resettlement has been implemented;
(fifteen) other conditions stipulated by laws, regulations and rules. Article 7 The relevant administrative departments responsible for the supervision of new residential construction shall perform their supervisory duties according to law, and implement the whole-process supervision and dynamic management of construction projects according to the principle of "who is in charge, who approves and who is responsible", so as to timely stop and correct the acts that violate the requirements of planning and construction. After the completion of the project, the relevant administrative departments shall conduct completion acceptance or filing in accordance with the relevant provisions. Eighth power supply, water supply, drainage, heating, gas supply, telecommunications, cable television and other units, should guide and cooperate with the construction unit to complete the construction of new residential special supporting facilities. After the project is completed, it will be delivered and accepted in time according to the application of the construction unit to ensure the normal life needs of residents. Article 9 Before a new house is delivered for use, a social review shall be conducted on whether the new house meets the delivery conditions. Without social review or social review unqualified, shall not be delivered for use.
For new houses that do not meet the delivery conditions, the municipal real estate administrative department shall not handle the filing procedures for commercial housing sales.
Social assessment funds into the municipal budget. Tenth social assessment work, by the owners' representatives, relevant experts, representatives of property management companies, the District People's government and community representatives composed of new residential delivery review committee (hereinafter referred to as the review committee).
There are 9 people in the judging committee, including 3 owners' representatives and related experts, and representatives of property management enterprises, district people's governments and communities 1 person. At the same time, select 1 director from relevant experts and 1 deputy director from the owner's representative. Each member of the jury has one vote.
Owners' representatives and relevant experts are randomly selected from the expert database established by the social evaluation organization unit from the new house purchaser and the municipal real estate administrative department. The lottery process and results shall be made public and notarized by the notary office on the spot.
The selection of members of the review committee shall be subject to the withdrawal system. Article 11 The review committee shall review the following contents:
(1) Whether the documents certifying that the newly-built residence meets the delivery conditions are complete;
(two) the documents issued by the relevant departments and units are consistent with the actual situation. Twelfth new residential delivery, the construction unit shall apply to the municipal real estate administrative department for social assessment, and submit the following documents:
(a) the approved project planning and the certification documents that have passed the planning acceptance;
(two) the project completion filing documents;
(3) Acceptance documents of environmental protection facilities;
(4) documents certifying that the engineering facilities such as power supply, water supply, drainage, heat supply, gas supply, telecommunications, cable television and so on have reached the delivery conditions;
(five) the courtyard facilities meet the delivery conditions;
(six) the filing documents of the previous property service contract;
(seven) the relevant public service houses and supporting facilities to undertake the acceptance procedures;
(eight) the demolition and resettlement documents have been implemented;
(nine) other documents stipulated by laws, regulations and rules.
If the greening, roads and other courtyard supporting facilities of the newly-built residence cannot be delivered at the same time with the newly-built residence due to seasonal reasons, it shall also provide a delivery guarantee for the courtyard supporting facilities of the newly-built residence. The letter of guarantee shall include the delivery time of the courtyard supporting facilities and the standards that should be reached when delivery.
The construction unit shall be responsible for the authenticity of the application documents. The relevant departments or units shall truthfully issue certificates and shall not resort to deceit.
