The house demolition management department shall strengthen the supervision and management of the intermediary agencies and appraisers engaged in the house demolition evaluation. If it is found that the assessment institution colludes with one party in bad faith, harming the interests of the other party, or has other obvious illegal acts, it shall cancel its qualification for house demolition assessment, and suggest the relevant departments to cancel the qualification of the assessment institution and appraiser.
The management department of house demolition shall regularly organize relevant departments and experts to evaluate the performance and credibility of intermediary agencies engaged in house demolition evaluation, and make it public. Article 6 In the case of classified assessment of house demolition, the demolisher shall publish the results of classified assessment within the scope of demolition, and the demolisher and the demolished person shall have the right to ask the assessment agency to explain the assessment report. Article 7 The appraisal institution determined by the house demolition management department shall announce the time and place of the lottery in the demolition area 3 days before the lottery. Eighth housing demolition management departments should invite experienced experts to form a demolition evaluation expert database. If the demolition party has any objection to the evaluation results, it may apply to the house demolition management department for organizing the appraisal of the evaluation results within 7 days from the date of delivery of the evaluation report. Appraisal by the house demolition appraisal expert group, whose members are determined by the house demolition management department from the expert database by drawing lots before appraisal.
If the household assessment results are accepted in the appraisal, the appraisal fee shall be borne by the appraisal applicant; If it is not accepted, the appraisal fee shall be borne by the original appraisal institution.
The expert conditions of the demolition evaluation expert database and the identification procedures of the expert group shall be formulated separately by the Municipal Housing Property Management Bureau. Ninth parties to the demolition compensation and resettlement can not reach an agreement to apply for a ruling, the applicant has applied for identification, the identification results as the basis for the ruling; Did not apply for identification, to household assessment results as the basis for the ruling.
Before applying for a ruling, if the household assessment is not carried out due to the reasons for the demolition, the ruling organ shall entrust an assessment agency to carry out the household assessment, and the expenses shall be borne by the demolition person, and the results of the household assessment shall be used as the basis for the ruling; If the household assessment cannot be carried out due to the demolition, the ruling organ shall make a ruling with reference to the compensation amount of similar houses. Article 10 If the parties fail to reach an agreement on compensation and resettlement and apply for an award, and the decoration of the demolished house cannot be verified due to the reasons of the demolished person or lessee, the decoration compensation shall be verified by the evidence preservation institution when executing the award, and the demolisher shall make compensation according to the Compensation Standard for Urban House Demolition and Decoration in Changsha (see Annex). Eleventh centralized housing, the housing demolition management department to determine the public lottery assessment agencies for classified assessment, not for household assessment. Non-residential resettlement houses or sporadic resettlement houses are evaluated by the institutions that conduct household assessment on the demolished houses; Without household assessment, it shall be assessed by the original classification assessment agency. Take monetary compensation, fully control the relocation compensation funds of the relocated households; Take a one-time property exchange compensation and resettlement, 80% of the household demolition compensation funds will be paid, and the remaining demolition compensation funds will be paid after the completion of the resettlement housing property rights procedures; If transitional resettlement is adopted, it shall be distributed in batches according to the construction progress of resettlement houses, but only 80% of the compensation funds for demolition can be distributed. Only after the relocated people have moved into the resettlement houses and gone through the formalities of property rights of the resettlement houses, can the remaining compensation funds be distributed. Thirteenth unfinished demolition compensation and resettlement construction projects, without the consent of the housing demolition management department, shall not be transferred; If the house demolition project has not been accepted by the demolition management department, the new house of the construction project shall not issue the construction project planning permit, construction permit and pre-sale permit of commercial housing. Article 14 For the residents who enjoy the social minimum living allowance in this Municipality and have particularly difficult living conditions, the residents who voluntarily choose the property right exchange method will provide houses with a construction area of not less than 36 square meters for compensation and resettlement, and the above-mentioned tenants who directly manage public houses will be resettled by the property right exchange method, with a total rental area of not less than 25 square meters.
