Measures for the administration of bidding for garden projects
Article 1 These Measures are formulated in accordance with the Bidding Law of People's Republic of China (PRC) Municipality and relevant regulations in order to standardize the bidding behavior of landscaping maintenance in this Municipality, maintain the market order of landscaping maintenance, protect the public interests and the legitimate rights and interests of the bidding parties, and improve the quality and management level of urban landscaping maintenance. Article 2 These Measures shall apply to the management units, landscaping maintenance enterprises and related units engaged in bidding activities within the scope of Haishu District, jiangdong district District and Jiangbei District of this Municipality. Article 3 The Municipal Urban Management Bureau (hereinafter referred to as the Municipal Urban Management Bureau) shall be in charge of the tendering and bidding for landscaping maintenance in this Municipality. The Municipal Bureau of Landscape Architecture (hereinafter referred to as the Municipal Bureau of Landscape Architecture) is entrusted by the Municipal Urban Management Bureau to be responsible for the specific management of landscaping maintenance bidding. Its main duties are: (1) to implement the laws, regulations, guidelines and policies of the state on bidding; (two) responsible for drafting the annual maintenance bidding plan and the registration of landscaping maintenance bidding projects; (three) guidance, inspection and supervision of landscaping maintenance bidding; (four) responsible for the formulation of maintenance assessment standards and methods, regular inspection and assessment. Article 4 The following landscaping maintenance projects must be subject to tender: (1) Green space projects (excluding special parks and nurseries) with an investment of 1 10,000 square meters or an annual maintenance budget of 65,438+10,000 yuan; (2) Projects that have been tendered and maintained by the public. Fifth landscaping maintenance project bidding by the tender unit, the tender unit should be the property owner or manager of landscaping facilities. Article 6 Where a bidder needs to bid for landscaping maintenance, it shall apply to the Municipal Bureau of Gardens for project registration. A project subject to tender shall meet the following conditions before it can be registered: (1) Newly-built, rebuilt and expanded projects have passed the completion acceptance, the receiving unit has been determined, and the construction unit has passed the rectification acceptance for one year; (2) All technical data and drawings required for the project have been prepared; (3) The project subject to tender has been included in the annual maintenance plan; (four) the source of maintenance funds has been implemented. Seventh landscaping maintenance projects can take two ways: public bidding and invitation bidding, in which the invitation bidding method needs to be approved by the Municipal Bureau of Landscape Architecture in advance and approved by the Municipal Urban Management Bureau. Where public bidding is adopted, the tenderee shall organize the release of bidding information for landscaping maintenance projects through Ningbo Urban Management Network, Ningbo Landscaping Network or other means, and inform the maintenance project scale, corresponding conditions, qualification requirements and the way to obtain relevant bidding information. In case of public bidding, there shall be no less than three bidders with valid qualifications. If there are less than three bidders, the bidding information shall be re-released, or with the consent of the Municipal Bureau of Landscape Architecture, it shall be reported to the Municipal Urban Management Bureau for approval and invited bidding shall be adopted. However, the registered qualified bidders shall be taken as the tender targets. When the bidding enterprises that meet the bidding conditions exceed the specified number of bids, the bidding unit shall determine the bidding unit by drawing lots. In case of inviting tenders, the tenderee shall issue invitations to bid to more than three maintenance units. After the invitation to bid is issued, the actual bidding units shall not be less than three. Article 8 A tenderer shall bid for landscaping maintenance according to the following procedures: (1) Organizing a bidding working group; (two) the preparation of bidding plans, schemes and bidding documents, and report to the Municipal Bureau of Gardens for approval; (three) to organize the release of bidding information for landscaping maintenance or to issue an invitation for bidding; (4) Examining the qualifications of bidders who apply for bidding, and informing the applicant of the examination results; (five) to issue bidding documents and related drawings and technical data to qualified bidders, and collect bid bond; (six) the establishment of a bid evaluation team, formulate bid evaluation and calibration methods; (seven) the organization of bidders on-site reconnaissance, and answering questions on the tender documents; (eight) held a bid opening meeting to review the tender; (9) Organizing bid evaluation and determining the winning bidder; (ten) issued a letter of acceptance; (eleven) the tenderer and the winning bidder signed a maintenance contract. The way of inviting tenders can be simplified appropriately. Article 9 The tender documents shall clearly state the main contents, contract elements and principles of bid evaluation and calibration of maintenance projects. If the tenderer needs to make necessary clarifications or amendments to the issued tender documents, it shall promptly notify all maintenance enterprises that have received the tender documents in writing before the deadline for submitting the tender documents. The contents of this clarification or modification shall be considered as an integral part of the tender documents after being audited by the Municipal Bureau of Landscape Architecture and approved by the Municipal Urban Management Bureau. Tenth bidding documents, bid evaluation methods and rules shall be approved by the Municipal Bureau of Landscape Architecture and approved by the Municipal Urban Management Bureau before being sold. Article 11 The preparation of the pre-tender estimate shall be based on the tender documents, drawings and relevant materials. Twelfth maintenance project evaluation methods can be used in the form of composite bid or commercial bid according to the actual situation. Article 13 Once the pre-tender estimate has been approved, it shall be sealed and kept until the bid opening, and shall not be disclosed. Once the pre-tender estimate is leaked, the bid shall be re-opened, and the expenses incurred therefrom shall be borne by the responsible party, and the relevant responsibilities of the responsible party shall be investigated. Article 14 A tenderer shall examine the qualifications of greening construction enterprises participating in bidding. The greening construction enterprises participating in the bidding shall provide the following materials at the same time when submitting the bidding application to the tenderer: (1) the business license of the enterprise; (two) the qualification certificate of the landscaping enterprise; (3) Other materials that need to be provided. Article 15 A bidder shall pay a bid bond when bidding. The deposit shall be charged according to the maintenance workload, and the maximum amount shall not exceed 5% of the maintenance fund of the maintenance project. Deposits can be cash, checks, money orders, etc. Article 16 If a bidder finds that his bid is wrong, he shall supplement and correct it by official letter before the deadline for bidding, otherwise it will be invalid. Seventeenth bid opening, bid evaluation and calibration activities under the supervision of the Municipal Bureau of Gardens and the discipline inspection and supervision department of the tender unit, presided over by the tender unit. At the time of bid opening, the legal representative of each bidder or his entrusted agent shall be present, and the staff shall unseal the tender in public, announce the main contents of each bidder's tender, and announce the final reasonable pre-tender price. Article 18 A bid document shall be deemed invalid under any of the following circumstances: (1) It is not sealed as required; (two) do not fill in the prescribed format, the handwriting is vague, illegible or incomplete; (three) without the official seal of the unit or the seal of the legal representative; (four) overdue delivery; (5) The bidder fails to attend the bid opening meeting within the specified time; (six) other matters that do not meet the requirements of the tender documents. Article 19 The bid evaluation team shall be responsible for bid evaluation. The total number of members of the bid evaluation team shall be an odd number of not less than 5. For projects entering the district bidding center, the members of the bid evaluation team shall be randomly selected and determined by the district bidding center from the urban landscaping maintenance bid evaluation expert group; Other projects, by the Municipal Bureau of Landscape Architecture from the city landscaping maintenance evaluation expert group randomly selected to determine. No less than 20 members of the landscaping maintenance bid evaluation expert group shall be established by the Municipal Bureau of Landscape Architecture in conjunction with the District Urban Management Bureau and reported to the Municipal Urban Management Bureau for the record. If the bid evaluation experts have an interest in the bidding unit, they should be avoided, and the proportion of experts should comply with the relevant provisions. The list of bid evaluation experts shall be kept confidential before the results of winning the bid are announced. Article 20 The time from bid opening to bid selection is generally not more than seven days, and may be appropriately extended under special circumstances. Article 21 The bid evaluation team shall conduct a fair, scientific and reasonable evaluation of the bid documents according to the bidding documents and bid evaluation rules, and recommend the candidate winning units in parallel. The tenderer shall determine the winning bidder according to the written bid evaluation report put forward by the bid evaluation expert group and the recommended candidate winning bidders, or may authorize the bid evaluation expert group to directly determine the winning bidder. Twenty-second after the end of the bid evaluation, the bid evaluation results shall be published in Ningbo Urban Management Network and Ningbo Landscaping Network in a timely manner, and shall be subject to public supervision. At the same time, send a letter of acceptance to the winning bidder and send a copy to the unsuccessful bidder. Twenty-third the tenderer and the winning bidder shall sign a written contract within twenty days after the bid-winning notice is issued, and report the contract to the Municipal Bureau of Gardens for the record. The main contents of the contract must be consistent with the main contents of the tender documents and tenders, and the contract price should be equal to the tender price, and the maintenance period is clearly stipulated as two years and the relevant liability for breach of contract. The winning bidder shall submit a performance bond and be responsible to the tenderer for the contracted project. The winning bidder shall fulfill its obligations in accordance with the contract and complete the winning project. The winning bidder shall not transfer the winning project to others, nor shall it dismember the winning project and transfer it to others separately. Article 24 If the winning bidder fails to sign the contract within the time limit, it shall be deemed as giving up the qualification of winning the bid, and the bid bond shall not be returned. At the same time, send a copy to the Municipal Bureau of Landscape Architecture, determine the winning bidder according to the ranking of the candidate winning bidders, and sign a contract with the Municipal Bureau of Landscape Architecture after approval. Twenty-fifth after the tender, the tenderer shall return the bid bond to other unsuccessful units. Twenty-sixth landscaping maintenance to implement a regular assessment system. City and district landscaping management departments shall set up a maintenance supervision and assessment team, and the municipal maintenance inspection team shall be set up by the Municipal Bureau of Gardens, and conduct an assessment of the landscaping maintenance in each district every quarter, and report the assessment results; District Urban Management Bureau set up a district maintenance assessment team, which is responsible for the daily management and assessment of landscaping maintenance within its jurisdiction. The assessment is not less than once a month, and the assessment results are reported to the maintenance unit (send a copy to the Municipal Bureau of Landscape Architecture). Twenty-seventh districts shall, according to the completion and acceptance of the landscaping construction projects in their respective jurisdictions, declare the tender plan for green space maintenance for the next year to the Municipal Bureau of Gardens in June 5438+ 10 every year. The maintenance bidding scheme shall include the handover date, area, maintenance level, location, bidding benchmark price, etc. The Municipal Bureau of Landscape Architecture conducts preliminary examination according to the declaration plan of each district, prepares the annual bidding plan and reports it to the Municipal Urban Management Bureau for approval. The Municipal Urban Management Bureau uniformly issued the annual tender plan for greening and maintenance. The Municipal Urban Management Bureau will incorporate the approved annual bidding plan into the urban management city maintenance fund plan, and allocate the maintenance funds involved to the Municipal Bureau of Landscape Architecture, which will allocate them to the urban management bureaus of all districts according to the implementation. Article 28 According to the spirit of No.313 [2002] of Yongcai Cycle, the green space maintenance fund for new bidding shall be subsidized by the municipal government by 50% and borne by the district finance by 50%. Twenty-ninth meet the delivery conditions of green space, from the time of receipt to the time of bidding for the transitional period maintenance, by the takeover unit entrusted to the relevant professional units for the first time maintenance, and included in the scope of assessment, maintenance funds according to the winning bid price settlement. Article 30 Where bidding should be carried out in accordance with these measures without directly designating a maintenance unit through bidding, or there are other acts in violation of the provisions of these measures, the discipline inspection and supervision department of the Municipal Urban Management Bureau shall investigate the administrative responsibility of the relevant personnel, and if the case constitutes a crime, it shall be transferred to judicial organs for handling.
