The administrative departments of finance, price, industry and commerce, water conservancy, transportation, environmental protection, ocean and land, public security organs, etc. shall, according to their respective functions and duties, cooperate with the fishery administrative departments to manage fishery work. Article 4 The government encourages the development and utilization of fishery resources, conducts research and popularization of fishery science and technology, improves the level of fishery science and technology and develops fishery production. Fifth fishery administrative departments may, according to the needs, set up fishery agencies or send fishery inspectors in fishery waters and fishery townships (towns). Fishery inspectors must undergo strict training and assessment, and the fishery inspector certificate shall be issued by the provincial fishery administrative department. Article 6 All units and individuals have the obligation to protect fishery resources, and have the right to report and expose violations of the Fisheries Law, the Detailed Rules of the Fisheries Law and these Measures. Chapter II Aquaculture Article 7 Units or individuals that engage in aquaculture by using water surfaces and beaches owned by the whole people as determined by state planning shall apply to the fishery administrative department of the local people's government at or above the county level, and the people's government at the same level shall issue a aquaculture license. Eighth state-owned or collectively owned water surfaces and beaches, which are contracted by units or individuals, shall sign a contract to engage in aquaculture production in accordance with the contract. Article 9 It is forbidden to engage in fishery breeding activities in fishing port waters, ship anchorage and waterway waters. Chapter III Fishing Industry Article 10 Units and individuals engaged in fishing industry must apply to the fishery administrative departments for fishing licenses uniformly printed by the provincial fishery administrative departments. Eleventh "fishing license" shall be approved in accordance with the following provisions:
(a) large trawling and purse seining operations shall be approved by the fishery administrative department of the State Council;
(two) bottom trawling and floating trawling operations shall be approved and issued by the provincial fishery administrative department;
(three) the fixed net operation shall be approved by the municipal fishery administrative department;
(four) other fishing gear operations, approved by the county fishery administrative department. Twelfth fishing boats must meet the following requirements:
(1) Name and number of the ship.
(2) Having a vessel certificate (referring to the fishing vessel inspection certificate, vessel registration certificate and fishing license).
(3) Having a port of registry.
Fishing boats that do not meet the provisions of the preceding paragraph (hereinafter referred to as "three noes" fishing boats, the same below) shall not fish. Thirteenth fishing boats from other provinces to enter the waters under the management of our province to catch local fishery resources must hold the documents approved by the local fishery administrative department, obtain the special fishing license from the fishery administrative department of our province, and pay the protection fee for the proliferation of special varieties. Chapter IV Protection of Fishery Resources Article 14 In the construction of dams, sluices and other projects that have a serious impact on fishery production in aquatic animal migration channels, attachment areas, rivers, fishing ports, beaches and other fishery waters, the construction unit shall build fishing facilities or take other remedial measures. Fifteenth prohibit the fishing of aquatic animal fry with important economic value. For breeding or other special needs, fishing fry with important economic value or brooding parents whose fishing is prohibited must be approved by the provincial fishery administrative department, and fishing shall be carried out according to the quota in the designated area and time. Article 16 The following illegal acts are prohibited:
(1) Fried fish, poisonous fish and electric fish.
(2) Fishing in closed fishing areas and closed fishing periods.
(3) Fishing with prohibited fishing gear and nets smaller than the prescribed standard mesh size, and fishing with nets during the fishing ban.
(four) in violation of the provisions of the fishing license on the type, place, time limit and the number of fishing gear.
(5) Soaking and cleaning toxic appliances and other articles harmful to fishery resources in aquaculture waters. Article 17 It is forbidden to dump or discharge toxic and harmful substances into fishery waters.
Accidents resulting in loss of fishery resources due to pollution of fishery waters shall be investigated and handled by the fishery administrative department. Article 18 It is forbidden to engage in all activities that destroy fishery resources, such as ship dismantling, in fishing ports, fry bases, breeding areas, spawning grounds and feeding grounds. Nineteenth units and individuals engaged in fishing industry shall pay the fishery resources proliferation protection fee and special species proliferation protection fee to the fishery administrative department.
The fee for the proliferation and protection of fishery resources and the fee for the proliferation and protection of special varieties shall be collected in strict accordance with the law for the proliferation and protection of fishery resources, and the specific collection and use measures shall be implemented in accordance with the relevant provisions of the state and the province. Chapter V Awards and Penalties Article 20 Whoever commits any of the following acts shall be commended or rewarded by the people's government:
(a) the development, utilization and protection of fishery resources, the development of fishery production has made remarkable achievements.
(2) Having made outstanding contributions to the research and popularization of fishery science and technology.
(three) report and expose illegal fishing activities.
