Measures of Fuzhou Municipality on Safeguarding Low-rent Housing
Chapter I General Provisions
Article 1 In order to further improve the urban low-rent housing system and ensure the basic housing needs of urban low-income families with housing difficulties, these measures are formulated in accordance with the provisions of Several Opinions of the State Council on Solving the Housing Difficulties of Urban Low-income Families, the Measures for Safeguarding Low-rent Housing by the Ministry of Construction and the Implementation Opinions of Fujian Provincial People's Government on Solving the Housing Difficulties of Urban Low-income Families, and in combination with the actual situation of our city.
Article 2 These Measures shall apply to the guarantee, supervision and management of low-rent housing for low-income families with housing difficulties in five urban areas of our city. The term "urban low-income families with housing difficulties" as mentioned in these Measures refers to urban families whose annual household income and housing conditions meet the requirements of the municipal government.
Article 3 Fuzhou Real Estate Management Bureau (hereinafter referred to as the Municipal Housing Management Bureau) is the administrative department in charge of low-rent housing security, and the office of Fuzhou Housing Committee is specifically responsible for daily management. Fuzhou State-owned Real Estate Management Center (hereinafter referred to as "State Housing Center") is responsible for raising, distributing and managing low-rent housing. The Municipal Finance Bureau, the Municipal Bureau of Land and Resources, the Civil Affairs Bureau, the Municipal Price Bureau, the Municipal Federation of Trade Unions and other departments shall, according to their respective responsibilities, coordinate the implementation of these measures. District housing management department in conjunction with the relevant streets (towns) to do a good job in the preliminary examination, review and investigation and verification of low-cost housing.
Chapter II Safeguard Methods
Article 4 The allocation of low-rent housing should take various forms, such as rental subsidies, in-kind distribution of rent and rent reduction, to solve the housing problem of urban low-income families through multiple channels. Rental subsidy means that the government issues monetary subsidies for housing rental to urban low-income families with housing difficulties who meet the conditions of low-rent housing security, and they rent their own housing to solve the housing problem. Shiwupeizu means that the government provides low-rent housing to urban low-income families with housing difficulties who meet the conditions of low-rent housing security, and collects rent according to the prescribed standards. Rent reduction refers to the government's rent reduction for urban low-income families who meet the conditions of low-rent housing security.
Fifth new low-cost housing single construction area should be controlled within 50 square meters. The specific construction area of the apartment is determined as follows: the first generation (type A) is controlled at about 30 square meters; The second generation type (type B) is controlled at about 40 square meters; The third generation type (type C) should be controlled within 50 square meters.
Sixth low-cost housing rent standards and rental subsidy standards by the Municipal Price Bureau in conjunction with the Municipal Housing Authority, the Municipal Finance Bureau, the Municipal State Housing Center, the Municipal Real Estate Transaction Registration Center and other departments in accordance with the provisions of the approved, and reported to the municipal government for approval before implementation.
Chapter III Guarantee Funds and Housing Sources
Seventh low-cost housing security funds mainly from the budget, a variety of channels to raise at the same time, including:
(a) the annual low-cost housing security fund budget;
(two) the balance of value-added income after the housing provident fund withdraws the loan risk reserve and management fee;
(3) The net income from land transfer is not less than 10% of the low-rent housing security fund;
(four) the funds arranged in the compensation fee for the direct management of public houses and the demolition of public houses;
(five) the provincial budget for low-cost housing subsidies;
(six) social donations and other ways to raise funds.
Eighth low-cost housing security funds to implement special management, special account accounting, earmarking, earmarked for low-cost housing security expenditures, including new construction, acquisition, renovation of low-cost housing and rental subsidies. Government low-rent housing rental income should be managed in accordance with the relevant provisions in accordance with the principle of two lines of revenue and expenditure, earmarked for the maintenance and management of low-rent housing.
Ninth low-cost housing sources mainly include:
(1) Housing newly built or purchased by the government;
(2) vacating public housing;
(three) low-cost housing in affordable housing or ordinary commercial housing;
(4) Houses donated by the society;
(five) other channels to raise housing.
The low-rent housing with Shiwupeizu shall be managed uniformly by the Municipal State Housing Center, which shall promptly inform the Municipal Housing Authority of the collection and use of the housing.
Tenth low-cost housing construction land should be given priority in the land supply plan, and listed separately when reporting the annual land use indicators, and the allocation method should be adopted to ensure supply; The planning and layout of low-rent housing construction land should consider the convenience of living and employment for urban low-income families with housing difficulties; The construction of low-rent housing should adhere to the principle of economy and applicability, improve the level of planning and design, meet the basic use functions, and popularize new materials, new technologies and new processes in accordance with the requirements of developing energy-saving and land-saving environment-friendly housing. Low-rent housing should meet the national quality and safety standards.
Eleventh low-cost housing construction shall be exempted from administrative fees and government funds.
Encourage the community to donate housing as low-rent housing or donate funds for low-rent housing construction.
Houses built, purchased and rebuilt by the government or units recognized by the government are used as low-rent houses, and the society donates low-rent houses. Preferential tax policies shall be implemented in accordance with the relevant provisions of the state.
Twelfth low-cost housing should be equipped with basic living facilities, so that it has the conditions for occupancy.
Thirteenth new low-cost housing should rely on a residential area to implement unified property management, low-cost housing tenants must pay property management fees. Belonging to low-income families, the property management fee is fully subsidized by the finance, and the municipal and district finances bear 50% respectively.
Chapter IV Application and Approval
Fourteenth to apply for low-cost housing security shall meet the following conditions:
(a) with five urban hukou (except rural villagers and members of rural collective economic organizations), and work and live in this city;
(2) Having settled in five urban areas of this Municipality for three years;
(three) the annual household income conforms to the family income standard of the low-rent housing security object announced by the municipal government;
(four) the per capita housing construction area of the family is lower than the per capita housing construction area standard of the low-rent housing guarantee object announced by the municipal government in that year. If the applicant is married, the annual income and housing construction area of his spouse must be combined with the applicant. Immediate family members (spouse, parents and children, hereinafter referred to as immediate family members) who are in the same household registration book with the applicant, their annual income and housing construction area shall be calculated together with the applicant. If the applicant and his immediate family members have moved out of the household within 3 years before the date of application, the annual income and housing construction area of immediate family members should still be calculated together with the applicant.
Fifteenth applicants in any of the following circumstances, shall not apply for low-cost housing security:
(a) through the purchase of commercial housing to obtain the city's five urban household registration;
(two) the purchase or sale of commercial housing within 5 years before the date of application;
(three) the applicant or his spouse has enjoyed preferential government housing policies;
(four) although the applicant and his spouse have divorced, but the divorce time is less than 2 years;
(five) although the applicant and his spouse divorced for 2 years, but before the divorce, one party has enjoyed the preferential price policy of the government;
(six) although the applicant has established a housing provident fund account, but the account has not been established at the city level.
Sixteenth low-cost housing application, review and publicity system. The procedure is as follows:
(1) Application: The applicant applies to the neighborhood office or town government where he lives, fills in the form and submits the following materials: 1, the ID card and household registration book of the applicant and his immediate family members whose annual income and housing construction area are calculated together; Married people provide marriage certificates; Divorce provides divorce certificate, divorce agreement and proof of support for minor children; Unmarried or widowed to submit a statement. 2, the applicant's domicile neighborhood offices (town government) issued by the non villagers or members of rural collective economic organizations. 3, the applicant and his immediate family members actually live in the community (neighborhood) issued by the current housing certificate; If there is a work unit, it is also necessary to submit a certificate issued by the unit whether there is housing allocation. 4. Proof of the income of the applicant and his immediate family members in the previous year (salary income includes basic salary, various subsidies or other income provided by the unit); Personal income tax payment certificate or unit withholding certificate of the previous year; If there is no work unit, provide unemployment certificate or proof of unemployment and actual income issued by community (neighborhood Committee) and sub-district office. 5. If the applicant has established a housing provident fund account, submit a certificate of housing provident fund deposit; If the housing provident fund account has not been established, the work unit shall issue relevant certificates that the housing provident fund account has not been established. 6. Families with special difficulties, such as urban subsistence allowances, severely disabled people above grade two, and key entitled groups enjoying old-age subsidies, should provide relevant certificates.
(2) Preliminary publicity: The subdistrict office and the town government shall, within 20 days from the date of receiving the application, investigate and verify the applicant's household registration, family income, years of residence and housing. Through family surveys and neighborhood visits. The applicant and the relevant organizations or individuals shall accept the investigation and truthfully provide relevant information. After investigation and verification, the subdistrict office and the town government shall put forward preliminary opinions on the applicant's conditions, and publicize the applicant's family population, current residence, housing situation, years of settlement, family income and work unit. In the community where the applicant lives. The publicity period is 15 days. Any organization or individual who disagrees with the publicity shall submit it to the subdistrict office and the town government in written form, and the subdistrict office and the town government shall re-investigate and verify it within 10 days from the date of receiving the written objection. After publicity, if there is no objection or objection is not established, the sub-district office and the town government will sign an opinion and submit the application materials to the local Housing Authority (Mawei District Housing Authority).
(III) Audit: Each district housing management bureau (Mawei District Housing Management Office) shall, within 10 days from the date of receiving the preliminary examination materials, check and verify the family housing situation of the applicants and their immediate family members within its jurisdiction, issue a written file check certificate, put forward an audit opinion on whether it meets the prescribed conditions, and transfer the application materials of the applicants who meet the application conditions to the civil affairs department at the same level; The civil affairs department shall, within 10 days from the date of receiving the application materials, put forward an audit opinion on whether the applicant's family income meets the prescribed conditions and return it to the District Housing Authority. The District Housing Authority will submit the application materials of applicants who meet the application conditions after examination to the Municipal Housing Authority. If the application conditions are not met after examination, the District Housing Authority shall notify the applicant in writing and explain the reasons. If the applicant disagrees with the results of the review, he may appeal to the District Housing Authority or the Municipal Housing Authority.
(IV) Approval and publicity: The Municipal Housing Authority will transmit the identity information of the relevant applicants and their immediate family members to the municipal real estate archives management institution, check and verify the housing situation of the applicants and their immediate family members, and publicize the applicants who meet the requirements of low-rent housing security after checking and auditing in newspapers and the municipal real estate joint information network. The publicity period is 15 days, and organizations or individuals who have objections shall submit them to the Municipal Housing Authority in writing. After receiving the objection, the Municipal Housing Authority will transfer to the District Housing Authority (Mawei District Housing Authority), and the District Housing Authority will re-investigate and verify with the relevant streets within 10, and report the verification results to the Municipal Housing Authority. Applicants who do meet the application conditions after examination shall be approved by the Municipal Housing Authority for their low-rent housing security qualifications and registered as low-rent housing security objects.
(5) Rent allocation: The Municipal Housing Authority will forward the approved registration results to the Municipal State Housing Center and send a copy to the Municipal Finance Bureau. Applicants who have obtained the qualification of low-rent housing security shall be arranged by the Municipal State Housing Center according to the housing situation. City State Housing Center shall, within the last 10 day of each quarter, report the list of low-rent housing security objects and security methods to the Municipal Housing Authority for the record.
Article 17 For families with shiwupeizu security, the Municipal State Housing Center shall, in combination with the housing difficulties of the applicant's family, wait for the allocation of rent, adopt the method of public lottery to choose the house, and make overall arrangements for low-rent housing. Under the same conditions, priority will be given to urban low-income families, families with severe disabilities above the second level, families with key special care recipients who enjoy old-age subsidies, and families of elderly people over 70 years old. Each family that implements the shiwupeizu guarantee can only rent a set of low-rent housing types corresponding to the structure of family members, and a generation of families rent type A; Second-generation families rent type B; Three generations of the same rent type C. The applicant shall sign the "Fuzhou Low-rent Housing Lease Contract" with the city housing center and go through the lease procedures for the families who are guaranteed to be rented in kind. Urban low-income families who have rented public houses before must withdraw from the original rented public houses within 10 days after moving into low-rent housing.
Eighteenth families to implement the lease subsidy guarantee, after reaching a preliminary lease intention with the lessor and reporting the lease intention to the Municipal State Housing Center, can sign a house lease contract with the lessor. City State Housing Center will directly allocate the rental subsidy funds to the lessor according to the prescribed standards to offset the housing rent. City State Housing Center shall report the amount of rental subsidies (including rental subsidies and rent reduction funds) in the next quarter to the Municipal Finance Bureau at the end of each quarter 10, and submit it to the Municipal Housing Authority for the record. After verification by the Municipal Finance Bureau, it will be allocated according to the capital expenditure channel.
Chapter V Supervision and Administration
Nineteenth city housing center can entrust the low-cost housing where the District Housing Authority and grass-roots housing management for lease management; District Housing Authority and grass-roots housing management offices should strengthen the tracking management of low-rent housing occupancy.
Twentieth families included in the low-cost housing security should truthfully declare their family income, family population and housing changes to the Municipal State Housing Center before the end of each year after the qualification examination. City State Housing Center shall verify and publicize the declaration, and report the verification results to the Municipal Housing Authority. City housing center to establish low-cost housing security object files, organize district housing management departments and related streets (towns) to do a good job in the follow-up supervision of low-cost housing.
Twenty-first in any of the following circumstances, the lease contract shall be terminated by the Municipal State Housing Center, and the housing in kind shall be recovered or the rental subsidy shall be stopped, and the qualification of low-rent housing shall be cancelled by the Municipal Housing Authority:
(a) the family income exceeds the prescribed income standard for more than one year in a row;
(two) the lease of low-cost housing lent, sublet or unauthorized exchange;
(3) changing the purpose of the house without authorization;
(four) for more than six months without paying rent or living in low-cost housing;
(five) unauthorized renovation and expansion of low-cost rental housing;
(six) the use of low-cost housing for illegal activities or illegal profits.
For families who refuse to return low-rent housing after the lease contract is terminated, the Municipal State Housing Center will prosecute according to law and apply to the people's court for compulsory execution.
Article 22 whoever defrauds the low-rent housing guarantee shall be disqualified from the low-rent housing guarantee by the Municipal Housing Authority, and the low-rent housing shall be recovered by the Municipal State Housing Center or the rental subsidy and rent reduction shall be stopped, and the rental subsidy already paid shall be ordered to be returned or the rent reduction shall be supplemented. If the case constitutes a crime, criminal responsibility shall be investigated by judicial organs according to law. Any functionary of the administrative department of the government who neglects his duty, abuses his power, engages in corruption and bribery, engages in malpractices for personal gain, shall be given administrative sanctions by his unit or the competent department at a higher level, and if the case constitutes a crime, criminal responsibility shall be investigated by judicial organs according to law.
Article 23 These Measures shall come into force as of the date of promulgation. The original "Fuzhou low-cost housing management measures" (Zheng Rong comprehensive [2006] No.255) shall be abolished at the same time.
