In order to strengthen funeral management, promote funeral reform, and promote the construction of socialist spiritual civilization, these measures are formulated in accordance with the relevant provisions of the Regulations on Funeral Management in the State Council, the Measures for the Administration of Funeral in Henan Province and the Regulations on the Administration of Funeral in Zhengzhou City, combined with the actual situation of our county:

First, cremation management.

Article 1 All the dead in this county (except ethnic minorities stipulated by the state) must be cremated, and burial of remains is strictly prohibited.

The second kind of normal death is issued by the hospital or the unit where the deceased is located, the town (street office) and the village (neighborhood) Committee, and the funeral home is notified to pick up the remains for cremation; Abnormal death such as traffic accident death, unknown corpse, criminal execution, etc. , by the municipal public security department or the people's court issued a death certificate, and notify the funeral home to receive cremation.

Article 3 Anyone who needs compensation after accidental death shall go to the relevant department for compensation with the cremation certificate issued by the funeral home, otherwise, the relevant department will not go through the relevant formalities.

Article 4 In order to facilitate management and prevent fraud, the remains of those who died in our city must be cremated in funeral home cremation, and cremation in other places is prohibited.

Fifth party member, cadres, employees and retirees of enterprises and institutions, their immediate family members do not cremate after death, in addition to punishment according to regulations, should also be given disciplinary sanctions.

Sixth in violation of the provisions of the burial, the town (street office) where the deceased was buried was forced to cremate, and the expenses required were self-care.

Article 7 The ashes shall be buried in the cemetery, stored in the columbarium and buried underground. There shall be no graves, tombstones and scattered, and trees shall be used instead. It is forbidden to bury ashes in coffins.

Article 8 Funeral homes shall build facilities for storing ashes to provide low-cost and high-quality services for survivors who store ashes.

Ninth Civil Affairs Bureau is the supervision and law enforcement department of funeral reform. Any unit or individual has the right to declare to the civil affairs department the remains that should be cremated during burial. Once verified, the civil affairs department will give rewards.

Second, funeral behavior and funeral supplies management

Tenth funeral activities should follow the principle of civilization and thrift, advocate thick burial and simple burial, and oppose extravagance and waste.

Article 11 It is forbidden to produce and sell funeral superstitious articles such as mingbi, paper articles, coffins and other funeral articles.

Article 12 It is forbidden to park dead bodies, set up sheds, place wreaths, play or broadcast funeral music, throw or burn money (paper money) in urban streets, village (residential) areas and other public places.

Thirteenth it is forbidden to engage in feudal superstitious activities such as fixing Yin and Yang, watching Feng Shui and tying paper in funeral activities.

Fourteenth it is forbidden for any unit or individual to transfer and illegally buy and sell cemeteries and graves.

Fifteenth in this city, the body of the deceased is organized by the municipal funeral home, and it needs to be transported by itself, which should be approved by the Civil Affairs Bureau. It is forbidden for any other unit or individual to engage in the business of transporting remains.

Sixteenth funeral service charges shall be implemented in accordance with the relevant provisions, and the charging standards shall be posted.

Seventeenth funeral service personnel should strictly abide by national policies and regulations, abide by professional ethics, perform their duties, and actively and seriously provide high-quality and efficient services for bereaved families.

Third, the funeral management of ethnic minorities

Article 18 Ethnic minority people who are allowed to be buried in the ground according to state regulations may be buried in the ground after death, but others may not interfere if they are cremated voluntarily.

Article 19 After the death of ethnic minorities, if burial is allowed according to the state regulations, the undertaker shall go to the municipal civil affairs department for burial or pick up the remains with the household registration book, identity card and death certificate issued by the deceased medical unit or the certificate issued by the local police station, and then pick up and bury the remains with this certificate.

Article 20 In areas where ethnic minorities live in concentrated communities where burial is allowed, ethnic minority cemeteries shall be established by using barren hills and wasteland, and cemeteries shall not be built within 1000 meters of cultivated land, forest land, scenic spots, cultural relics protection areas, drinking water source protection areas, reservoirs, canals, rivers, dams and both sides of railway and highway trunk lines.

Twenty-first minority graves where the remains are buried shall not exceed 4 square meters; Double burial shall not exceed 6 square meters.

Fourth, legal responsibility.

Twenty-second one of the following acts, the civil affairs department shall impose a fine of more than 2000 yuan 1000 yuan on the responsible units and responsible persons:

(a) issue false certificates or alter or forge burial certificates for cremation;

(two) to provide vehicles, land and other convenient conditions for cremation and burial;

(three) the hospital or funeral home allows or mismanages to transport the remains for burial.

Twenty-third prohibit the production and operation of Mingbi, paper and other funeral superstitious articles and coffins and other funeral articles. Otherwise, the civil affairs department shall, jointly with the industrial and commercial department, ban it, confiscate its illegal income, and impose a fine of more than 3 times the production and operation amount/kloc-0.

Twenty-fourth unauthorized construction of funeral facilities, shall be banned by the civil affairs department in conjunction with the construction management and land management departments, shall be ordered to make restitution, confiscate the illegal income, and impose a fine of more than 0 times and less than 3 times the illegal income.

Twenty-fifth hinder or interfere with the funeral management personnel to perform official duties according to law, gather people to make trouble, and violate the regulations on public security management, and the public security organs shall punish them according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 26 Where the deceased is a state functionary or an employee of an enterprise or institution. If the deceased is not cremated according to regulations, the unit to which he belongs shall not pay funeral expenses and subsidies for difficulties caused by funeral, except in accordance with regulations. Unauthorized distribution, in addition to being ordered to return, the unit leaders and responsible persons shall be given disciplinary and administrative sanctions.

Twenty-seventh funeral management and service personnel who engage in malpractices for personal gain, abuse of power, extortion, dereliction of duty, shall be given administrative sanctions by the competent authorities; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law.
