According to the provisions of Article 18 of the Regulations on the Planning and Construction of Villages and Market Towns, the following procedures are required:
Rural villagers in the village and market town planning area, should first apply to the village collective economic organizations or villagers' committees for building, after discussion and approval by the villagers' meeting, in accordance with the following approval procedures:
(a) need to use arable land, after the examination and approval of the people's governments at the township level, the construction administrative departments of the people's governments at the county level for examination and approval, and issue opinions on site selection, you can apply for land use to the land administration departments of the people's governments at the county level in accordance with the Land Administration Law, which will be allocated by the land administration departments of the people's governments at the county level after approval;
(two) the use of the original homestead, village homestead and other land, approved by the people's government at the township level according to the village and market town planning and land use planning.
Article 83 To apply for the initial registration of the ownership of a legally constructed house, the following materials shall be submitted:
(1) Application for registration;
(2) the identity certificate of the applicant;
(three) the certificate of the right to use the homestead or the certificate of the right to use the collectively owned construction land;
(4) The house applying for registration conforms to the urban and rural planning;
(five) the housing surveying and mapping report or the villagers' housing plan;
(6) Other necessary materials.
To apply for the initial registration of villagers' housing ownership, it shall also submit the certificate that the applicant belongs to the rural collective economic organization where the house is located.
When applying for the initial registration of house ownership, rural collective economic organizations shall also submit the certification materials approved by the villagers' meeting or authorized by the villagers' meeting and approved by the villagers' representative meeting.
: 1. When villagers rebuild their houses on their own homestead, they must first have a collective construction land use certificate. Homestead belongs to the scope of urban planning, and the planning department needs to issue opinions on the location of rebuilt houses and planning permits; If it is outside the scope of urban planning, it is necessary to change the area of the rebuilt house with the approval of the land management department before it can be rebuilt.
2. First, take your ID card, household registration book, original house photo and land certificate, and go to the local land department to go through the land examination and approval procedures-generally, the land office and the housing and construction office go through the relevant registration, and at the same time apply for the D-level dangerous house appraisal (this appraisal takes a long time, please consult the above two departments for details). Only after approval can the house be rebuilt.
3. After approval, go to the planning department for the construction permit. When the house is built, take these procedures to the local housing management office to apply for the house ownership certificate.
3. At present, many provinces have renovation projects of rural dilapidated buildings, so please fill in the renovation and maintenance report of dilapidated buildings, and apply for maintenance subsidies after village-level appraisal, township audit, county-level approval and municipal filing.
