Regulations of Huangshi Municipality on the Administration of Housing Safety

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this Municipality in order to strengthen the management of housing safety, safeguard the personal and property safety of natural persons, legal persons and unincorporated organizations, and maintain public safety. Article 2 These Regulations shall apply to the safety management activities of houses built and put into use on state-owned land and collective land in urban planning areas within the administrative area of this Municipality.

Fire safety management of houses, use safety management of elevators, gas, power supply, water supply, communication and other professional facilities and equipment, and housing safety management of military, cultural relics protection units and industrial heritage protection units shall be implemented in accordance with the provisions of relevant laws and regulations. Article 3 Housing safety management follows the principles of safe use, prevention first, territorial management and comprehensive management. Article 4 The Municipal People's Government shall strengthen the leadership of housing safety management within the administrative area of this Municipality, establish and improve the housing safety management system and mechanism, and coordinate and solve major problems in housing safety management.

County (city, district) people's government (including the Development Zone Administrative Committee, the same below) shall establish a housing safety supervision and management network, organize and coordinate relevant departments to do a good job in housing safety management.

Township people's governments, sub-district offices, etc. Should cooperate with relevant departments to do a good job in housing safety management. Fifth city and county (city) real estate administrative departments responsible for the administrative area of housing safety management. The housing safety departments in the districts and development zones shall be determined by the District People's Government and the Administrative Committee of the Development Zone, and shall be responsible for the housing safety management in this area.

City, county (city) construction administrative departments responsible for the safety management of housing decoration within their respective administrative areas.

Development and reform, economy and informatization, commerce, health and family planning, education, public security, finance, land and resources, transportation, culture, news, radio, film and television publishing, urban and rural planning, civil affairs, urban management, safety production supervision and management, sports and other departments. Should be within the scope of their respective duties, do a good job in the relevant housing safety management. Article 6 The people's governments of cities and counties (cities, districts) shall incorporate the funds for housing safety management into the fiscal budget at the corresponding level, ensure the needs of housing safety management and emergency disposal, and give appropriate subsidies to the safety appraisal and dangerous housing management of low-income families with special difficulties.

Encourage homeowners to diversify housing safety risks by buying home insurance. Seventh city, county (city) construction and real estate administrative departments should strengthen the business guidance and supervision of construction, decoration, property services and other industry associations, and support relevant industry associations to carry out housing safety related work according to law. Eighth city and county (city, district) people's government and its relevant departments should strengthen the publicity and education of housing safety knowledge, improve public awareness of housing safety.

Encourage the public to participate in housing safety activities and assist in housing safety publicity and education.

Any unit or individual has the right to dissuade, complain and report acts that endanger or affect housing safety, reflect the problems existing in housing safety management, and put forward opinions and suggestions on improving housing safety management to the competent department of housing safety. Chapter II Responsibility for Housing Safety Article 9 The owner of a house is the person responsible for housing safety. Housing is owned by the state or the collective, and its management unit is the person responsible for housing safety.

If the owner of the house is missing or the ownership of the house is unclear, the actual user or manager of the house shall be the person responsible for housing safety. Article 10 The owner of a house may agree with the actual user or manager of the house on the responsibility for house safety, but may not refuse to assume the responsibility of the person responsible for house safety on the grounds of agreement.

If the actual user or manager of the house finds that it is harmful or affects the safety of the house, he shall promptly inform the owner of the house. Eleventh housing security responsible person shall bear the following housing security responsibilities:

(a) according to the design structure, function and use of the house;

(two) take necessary measures such as inspection, maintenance, conservation and termite control to ensure the safety of the house and eliminate the hidden dangers of the house safety in time;

(3) Renovating houses in accordance with laws and regulations;

(four) commissioned by the housing safety appraisal;

(5) Managing dangerous houses in accordance with laws, regulations and other provisions;

(six) other housing safety responsibilities stipulated by laws and regulations. Twelfth construction units shall, in accordance with the provisions of laws and regulations and the contract, bear the responsibility of housing quality warranty.

Housing survey, design, construction, supervision and other units shall bear the responsibility for housing safety in accordance with the provisions of relevant laws and regulations and the contract signed with the construction unit. Thirteenth the use of property services entrusted to manage the house, the property service enterprise or other property managers shall, in accordance with the contract, inspect, maintain and repair the parts and facilities used in the house, and establish corresponding management files. If self-management is implemented, the daily management responsibility of the * * * used parts and * * * used facilities and equipment of the relevant houses shall be borne by the person responsible for housing safety according to law.

The daily management responsibility of the exclusive part of the house shall be borne by the person responsible for housing safety according to law.

In accordance with the provisions of the first and second paragraphs of this article, the cost of taking measures conforms to the relevant provisions on the extraction of special maintenance funds and housing provident fund, and can be extracted and used according to law.

If the residential special maintenance fund is not deposited, the administrative department of real estate of the city or county (city) shall guide and urge the owner of the house to deposit it according to law.
