Regulations of Guangdong Province on the Management of Water Resources in Dongjiang, Xijiang, Beijiang and Hanjiang River Basins

Chapter I General Provisions Article 1 In order to give full play to the comprehensive benefits of river basin water resources, realize the sustainable utilization of river basin water resources, prevent and control water disasters, and standardize the management of water resources in Dongjiang, Xijiang, Beijiang and Hanjiang river basins within the administrative region of this province, these Regulations are formulated in accordance with the Water Law of People's Republic of China (PRC) and relevant laws and regulations, and in combination with the actual situation of this province. Article 2 These Regulations shall apply to the water resources management activities in Dongjiang, Xijiang, Beijiang and Hanjiang river basins within the administrative area of this province.

Watershed water resources refer to the surface water and groundwater in the basin. Article 3 River basin water resources management shall be combined with administrative regional management. The water administrative department of the fourth provincial people's government is responsible for the unified management and supervision of water resources in river basins.

Dongjiang, Xijiang, Beijiang and Hanjiang river basin management agencies (hereinafter referred to as the river basin management agencies) shall perform the responsibilities of river basin water resources management and supervision as stipulated by laws and regulations and granted by the water administrative department of the provincial people's government.

The water administrative departments of the relevant municipal and county people's governments shall be responsible for the unified management and supervision of water resources within their respective administrative areas in accordance with the authority prescribed by laws and regulations; Other relevant administrative departments shall, in accordance with the division of responsibilities, coordinate the planning, allocation, conservation and protection of water resources. Chapter II Planning of River Basin Water Resources Article 5 The development, utilization, conservation and protection of water resources and the prevention and control of water disasters shall be planned according to river basins and regions.

Basin planning includes comprehensive planning and professional planning, and regional planning within the basin includes regional comprehensive planning and professional planning. Article 6 Regional planning within a river basin shall be subject to river basin planning, and professional planning shall be subject to comprehensive planning. The comprehensive planning of Dongjiang, Xijiang, Beijiang and Hanjiang River basins in this province shall be subject to the national comprehensive planning of the relevant basins.

Comprehensive river basin planning, regional comprehensive planning and professional planning closely related to land use should be coordinated with national economic and social development planning, overall land use planning, overall urban and rural planning and environmental protection planning. Article 7 The comprehensive river basin planning shall be compiled by the river basin management agency in conjunction with the water administrative department of the people's government at prefecture level and listed on the city level, audited by the water administrative department of the provincial people's government, approved by the provincial people's government, and reported to the water administrative department of the State Council for the record according to law.

River basin water resources protection, waterlogging control, water supply and other professional planning related to water conservancy shall be organized by river basin management agencies, audited by the water administrative department of the provincial people's government, and submitted to the provincial people's government for approval after soliciting the opinions of the relevant departments at the same level and the people's governments at the prefecture level. Eighth regional comprehensive planning by the water administrative department of the people's government of the city or county in conjunction with the relevant departments, submitted to the people's government at the same level for approval, and reported to the water administrative department of the people's government at the next higher level for the record.

Regional water resources protection, waterlogging control, water supply and other professional planning related to water conservancy shall be compiled by the water administrative department of the relevant municipal or county people's government, and submitted to the people's government at the same level for approval after soliciting the opinions of the relevant departments at the same level. Ninth river basin and regional planning should organize environmental impact assessment. Tenth river basin and regional planning, after approval, shall be announced to the public in a timely manner. When the plan needs to be revised, it shall be reported to the original approval authority for approval in accordance with the planning procedures. Eleventh water project construction shall conform to the comprehensive planning of the relevant river basins, and the feasibility study report of the project shall be submitted for approval in accordance with the relevant provisions of the state and the province. Before the feasibility study report of the project is submitted for approval, it shall be reported to the relevant river basin management agencies to review whether it conforms to the comprehensive river basin planning and sign opinions. The relevant administrative departments shall not approve the failure of river basin management institutions to sign opinions or the failure to conform to the comprehensive river basin planning after examination. Chapter III Water Distribution and Dispatching in River Basins Article 12 Water distribution in river basins shall be based on the river basin planning, the present situation of water resources in river basins and the supply and demand situation, and the water distribution scheme shall be formulated in units of river basins.

The principle of fairness, justice, sustainable utilization, conservation and protection, and dual control of water quality and quantity should be followed in formulating the water allocation scheme of river basin, so as to ensure the domestic water consumption of river basin residents and give consideration to the water consumption of production, shipping and ecological environment. Coordinate the interests of upstream and downstream, left and right banks, and coordinate water transfer outside the basin. Article 13 The water allocation scheme for river basins shall be formulated by the water administrative department of the provincial people's government jointly with the people's governments at the prefecture level and listed on the city level, and shall be submitted to the provincial people's government for approval after soliciting the opinions of the relevant departments of the provincial people's government. To adjust the water distribution scheme of river basins, the water administrative department of the provincial people's government shall, jointly with the people's governments at the prefecture level or above, organize investigation and demonstration, put forward a revised scheme according to the changes of water resources and water demand in river basins, solicit the opinions of relevant departments of the provincial people's government, and submit it to the provincial people's government for approval.

Watershed water allocation scheme includes intake allocation index, minimum flow index of important river control section and water quality control index.

The approved river basin water allocation scheme is the basis of total water consumption control and water regulation in the river basin and should be strictly implemented. The basin water allocation scheme involves municipal water allocation and water transfer outside the basin, which is organized and implemented by the basin management agency; Water allocation involving cities and counties shall be implemented by the water administrative department of the people's government of the relevant city or county in accordance with the management authority.
