Can Linyi set off fireworks?

Article 1 In order to strengthen the management of fireworks and firecrackers, reduce environmental pollution, and ensure personal and property safety, these Regulations are formulated in accordance with the Environmental Protection Law of People's Republic of China (PRC), the Air Pollution Prevention Law of People's Republic of China (PRC), the Regulations on the Safety Management of Fireworks and Firecrackers and other laws and regulations.

Article 2 These Regulations shall apply to the discharge of fireworks and firecrackers and their management activities within the administrative area of this Municipality.

Fireworks and firecrackers as mentioned in these Regulations refer to inflammable and explosive articles which are made of gunpowder as the main raw material and can produce light, sound, color, shape and smoke after being ignited.

Article 3 The people's governments of cities and counties (districts) shall strengthen the organization and leadership of the management of fireworks and firecrackers, co-ordinate the management of fireworks and firecrackers, and include the relevant funds for the management of fireworks and firecrackers into the financial budget.

Township people's governments and sub-district offices shall publicize, guide and urge the units and individuals within their respective jurisdictions to abide by these regulations and cooperate with relevant departments to do a good job in the supervision and management of fireworks and firecrackers.

Article 4 Public security organs shall be responsible for the supervision and administration of fireworks and firecrackers.

Education, civil affairs, ecological environment, housing and urban construction, urban management, transportation, cultural tourism, emergency management, administrative examination and approval services, market supervision and management, meteorology and other departments shall do a good job in the management of fireworks and firecrackers according to their respective responsibilities.

Article 5 South of changchun road, west of Yanshan Line-Wenquan Road-Volvo Road, west of Huaxia Road-Luocheng Road-Longtan Road-Torch Road-Hubei Road extend to the north of the first line of Beijing-Shanghai Expressway, and the east of Beijing-Shanghai Expressway is an area where fireworks and firecrackers are prohibited. Fireworks and firecrackers are prohibited in this area all year round.

Lanshan district, Luo Zhuang, Hedong District, and other areas where fireworks and firecrackers are prohibited are restricted. Fireworks and firecrackers are prohibited in this area. Fireworks and firecrackers are allowed to be set off on Lunar New Year's Eve, the first day of the first month and the fifteenth day of the first month, and are prohibited at other times.

The municipal and district people's governments may, according to actual needs, reasonably expand the area where fireworks and firecrackers are prohibited according to law, extend the time limit for fireworks and firecrackers, and announce it to the public.

Article 6 The county people's government may, according to the needs of air pollution prevention and control and local characteristics, delimit and announce the areas and time periods within its administrative area where fireworks and firecrackers are prohibited or restricted.

Seventh it is forbidden to set off fireworks and firecrackers in the following places:

(a) cultural relics protection units;

(2) Transportation hubs such as stations, docks and airports and railway line safety protection zones;

(3) Elevated roads, overpasses, overpasses, tunnels and underground spaces;

(four) the production, management and storage units of inflammable and explosive goods;

(five) power transmission and transformation, gas, fuel and other facilities in the safety protection zone;

(six) office areas, medical institutions, educational institutions, pension institutions, public cultural places, places for religious activities;

(seven) forests, scenic spots, wetlands, martyrs cemetery and other key fire prevention areas;

(eight) other places where fireworks and firecrackers are prohibited as prescribed by the people's government of the city or county (District).

In addition to the area where fireworks are prohibited, the county (District) people's government shall organize to set up a unified warning sign prohibiting fireworks at the place specified in the preceding paragraph.

Eighth heavy pollution weather warning period, no unit or individual within the administrative area of this Municipality shall set off fireworks.

The early warning of heavy pollution weather is determined by the Municipal People's Government according to the early warning report of the ecological environment and meteorological departments and announced to the public.

Ninth major festivals need to hold fireworks evening or other large-scale fireworks display activities, in accordance with the relevant provisions of the state.

Tenth in the area and time allowed to set off fireworks, fireworks shall comply with the following provisions:

(a) not to people, cars, buildings, underground pipe network, public green space;

(two) not from the roof, balcony, window and other places of the building. Go to public places;

(three) shall not hinder the safe passage of pedestrians and vehicles;

(four) fireworks and firecrackers shall not be set off in other ways that endanger public safety and personal and property safety.

After the discharge of fireworks and firecrackers, the discharge residue shall be properly disposed of in time.

Eleventh in the area and time allowed to set off fireworks, advocate the following acts:

(a) less or no fireworks;

(two) the use of pollution-free, low-noise fireworks substitutes;

(3) Setting off fireworks and firecrackers at designated places.

Twelfth people's governments at all levels and relevant departments and units shall organize publicity and education on setting off fireworks and firecrackers according to law, and increase publicity during major festivals and early warning of heavy pollution weather.

The relevant departments shall, when handling the business of market subject registration, marriage registration, household registration, property right registration, funeral registration, etc., carry out publicity and education on setting off fireworks and firecrackers according to law by issuing notices and setting up bulletin boards.

Radio, television, newspapers, internet and other media should carry out public welfare propaganda of setting off fireworks and firecrackers according to law.

Guardians of primary and secondary schools, kindergartens and minors shall educate minors about the safety of fireworks and firecrackers, and set off fireworks and firecrackers according to law.

Article 13 Villagers' committees and residents' committees shall cooperate with relevant departments and units to do a good job in the management of fireworks and firecrackers, guide them to change their customs, discharge fireworks and firecrackers legally, civilly and safely, and discourage illegal discharge of fireworks and firecrackers.

Encourage villagers' committees, residents' committees and owners' committees to incorporate the relevant contents of fireworks and firecrackers into village rules and regulations, residents' conventions and owners' statutes according to law.

Article 14 Units or individuals engaged in celebrations, weddings, funerals, banquets, etc. shall not provide services related to the discharge of fireworks and firecrackers to customers in areas and places where the discharge of fireworks and firecrackers is prohibited or during restricted time periods, and shall discourage illegal discharge of fireworks and firecrackers.

Fifteenth units and individuals found in violation of these regulations, have the right to report to the public security organs. If verified, the whistleblower will be rewarded.

Measures for reporting rewards shall be formulated by the public security organs of the Municipal People's Government and announced to the public.

Sixteenth in violation of the provisions of this Ordinance, one of the following acts, by the public security organs shall be ordered to stop the discharge, a fine of more than one hundred yuan to five hundred yuan; If it constitutes a violation of public security administration, it shall be punished according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) Setting off fireworks and firecrackers in areas and places where fireworks and firecrackers are prohibited;

(2) Setting off fireworks and firecrackers within the forbidden time in the area where fireworks and firecrackers are restricted;

(3) Setting off fireworks and firecrackers in a way that endangers public safety and personal and property safety.

Seventeenth in violation of the provisions of this Ordinance, fireworks during the early warning of heavy pollution, the public security organ shall order it to stop the discharge, and impose a fine on 500 yuan; If it constitutes a violation of public security administration, it shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 18 Where, in violation of the provisions of this Ordinance, units or individuals engaged in celebrations, weddings, funerals, banquets and other services provide services related to the discharge of fireworks and firecrackers in areas and places where the discharge of fireworks and firecrackers is prohibited, the public security organ shall order them to make corrections and impose a fine of not less than 1,000 yuan but not more than 5,000 yuan.

Article 19 The department in charge of fireworks management and its staff who violate the provisions of these regulations, abuse their powers, neglect their duties or engage in malpractices for selfish ends shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 20 These Regulations shall come into force as of the date of promulgation.
