First of all, the lottery sales behavior has its positive effect.
It can improve the enthusiasm of consumption, increase the welfare of consumers, expand the brand awareness of operators, and accelerate the capital turnover and commodity sales of operators;
Second, lottery sales also have negative effects.
It may undermine the normal market competition order, encourage irrational consumption and infringe on the legitimate rights and interests of consumers.
Third, there are two basic methods to regulate the sales with prizes.
1, it is strictly prohibited;
2. Restrictions are allowed. (Regulatory method adopted in China)
Article 13 of the Anti-Unfair Competition Law: "Operators shall not engage in the following sales with prizes: (3) Sales with prizes by lottery, and the maximum prize amount shall not exceed 5,000 yuan.
Article 4 of "Several Provisions on Prohibiting Unfair Competition in Lottery Sales Activities": For lottery sales with prizes, the maximum prize amount shall not exceed 5,000 yuan. If non-cash items or other economic benefits are used as rewards, the amount shall be converted according to the normal price of similar goods or services in the market during the same period.
