Conditions for applying for a work visa in China

Legal analysis: 1. Before employing foreigners to work in China, the employer shall apply for the Alien Employment Certificate.

2. The employing unit that is allowed to recruit foreigners shall present the employment certificate for foreigners issued by the administrative department of labor and social security;

3. Foreigners who are allowed to work in China should apply for a professional visa in embassies and consulates in China with a license issued by the labor department, a letter and telegram from the authorized unit and their valid passports or certificates that can replace passports;

4. The employing unit shall, within fifteen days after the entry of a foreigner who has obtained a professional visa, go to the Labor and Social Security Bureau with relevant materials to handle the Alien Employment Certificate for the foreigner.

Foreigners who have obtained employment permits should apply to the public security department for residence permits within 30 days after entering the country.

Legal basis: Article 18 of the Law of People's Republic of China (PRC) on Exit and Entry Administration, when applying for a visa, foreigners shall submit their passports or other international travel documents, as well as relevant materials on the reasons for their application, go through relevant procedures and be interviewed according to the requirements of overseas visa authorities.
