The process and time of public bidding for government procurement

The basic procedures of government procurement bidding include preparation stage and bidding stage. In the preparation stage, it includes demonstration and analysis of the bidding project, determination of procurement scheme, preparation of bidding documents, formulation of bid evaluation methods, establishment of bid evaluation institutions, and invitation of relevant personnel. In the bidding stage, it shall be organized and implemented according to the steps of bidding, tendering, bid opening, bid evaluation and bid selection.

First, open bidding.

The purchaser or procurement agency shall disclose the budget amount of the procurement project in the tender documents, negotiation documents and inquiry notice.

Article 31

The provision period of the tender documents shall not be less than 5 working days from the date of issuance of the tender documents. The purchaser or procurement agency may make necessary clarifications or amendments to the issued bidding documents. If the clarification or modification may affect the preparation of the tender documents, the purchaser or procurement agency shall notify all potential bidders who have obtained the tender documents in writing at least 15 days before the deadline for bidding; If it is less than 15 days, the purchaser or procurement agency shall postpone the deadline for submission of bid documents.

Article 32

The purchaser or procurement agency shall prepare the tender documents in accordance with the standard text of the tender documents formulated by the finance department of the State Council. The tender documents shall include business conditions, procurement requirements, bidder qualifications, bid quotation requirements, bid evaluation methods, bid evaluation criteria and the contract text to be signed.

Article 33

The department responsible for the preparation of departmental budgets shall list the government procurement projects and capital budgets for the next fiscal year and report them to the finance department at the same level for summary. The examination and approval of departmental budgets shall be conducted in accordance with the budget management authority and procedures.

1. Time for submitting prequalification application documents: not less than 5 working days from the date of announcement.

Article 21 of the Regulations for the Implementation of the Government Procurement Law

Where the purchaser or procurement agency prequalifies the supplier, the prequalification announcement shall be published in the media designated by the financial department of the people's government at or above the provincial level. If the pre-qualification has been carried out, the supplier qualification cannot be reviewed at the review stage. If the pre-qualified supplier's qualification changes during the review stage, it shall notify the purchaser and the procurement agency.

The prequalification announcement shall include the name of the purchaser and the procurement project, the procurement demand, the qualification requirements for the supplier, and the time and place when the supplier submits the prequalification application documents. The time for submitting pre-qualification application documents shall not be less than 5 working days from the date of announcement.

2. Time limit for pre-qualification announcement during bidding: no less than 7 working days.

3. Time limit for bidders to submit qualification documents during bidding: 3 working days before the end of the pre-qualification announcement period.

Fifteenth "measures for the administration of government procurement of goods and services"

In case of procurement by invitation to bid, the bidding procurement unit shall issue a pre-qualification announcement on the government procurement information media designated by the financial department of the people's government at or above the provincial level, and announce the qualifications of bidders. The pre-qualification announcement period shall not be less than 7 working days (Question 2).

The bidder shall submit the qualification documents according to the announcement requirements three working days before the end of the prequalification announcement period (Question 3). The bidding procurement unit randomly selects more than three bidders from qualified bidders and sends them an invitation to bid.

4. Publicity period of sole supplier for single-source procurement: no less than 5 working days.

Article 38 of the Regulations for the Implementation of the Government Procurement Law

Meet the standard of the amount of public bidding, meet the provisions of the first paragraph of Article 31 of the Government Procurement Law, and can only purchase from a sole supplier. The purchaser shall publicize the information of the procurement project and the name of the sole supplier in the media designated by the financial department of the people's government at or above the provincial level, and the publicity period shall not be less than 5 working days.

5. Time limit for providing bidding documents: not less than 5 days from the date of issuance of bidding documents.

6. Time limit for clarifying or modifying the bidding documents: before the deadline for bidding 15.

Article 31 of the Regulations for the Implementation of the Government Procurement Law

The time limit for providing the tender documents shall not be less than 5 working days from the date when the tender documents are issued (Question 5).

The purchaser or procurement agency may make necessary clarifications or amendments to the issued bidding documents. If clarification or modification may affect the preparation of bidding documents, the purchaser or procurement agency shall notify all potential bidders who have obtained the bidding documents in writing at least 15 days before the bidding deadline (Question 6); If it is less than 15 days, the purchaser or procurement agency shall postpone the deadline for submission of bid documents.

Twenty-seventh measures for the administration of bidding for government procurement of goods and services

If the bidding procurement unit makes necessary clarification or modification of the issued bidding documents, it shall issue a notice of correction on the government procurement information release media designated by the financial department before the deadline for submission of bidding documents 15 (Question 6), and notify all recipients of bidding documents in writing. This clarification or modification is an integral part of the tender documents.

7. Extension of deadline for bidding and bid opening: It shall be proposed 3 days before the deadline for bidding.

Twenty-eighth "measures for the administration of government procurement of goods and services"

The bidding procurement unit may extend the deadline for bidding and the time for bid opening according to the specific procurement situation, but at least it shall notify all recipients of the bidding documents in writing of the change time three days before the deadline for submission of bidding documents required by the bidding documents, and publish a change announcement on the government procurement information release media designated by the financial department.

8. Time limit for submission of bidding documents: not less than 20 days from the date of issuance of bidding documents.

Article 35 of the Government Procurement Law

Where goods and services are purchased by means of bidding, it shall not be less than 20 days from the date of issuance of the bidding documents to the deadline for submission of bidding documents by bidders.

Article 16 of the Measures for the Administration of Bidding for Government Procurement of Goods and Services

Procurement by tender shall not be less than 20 days from the date of issuance of tender documents to the deadline for submission of bid documents by bidders.
