What are the precautions for domestic trademark registration?

1. Does the trademark user voluntarily apply for registration of all its trademarks (except compulsory registration), but unregistered trademarks are not protected by law? If others register first, they will be in danger of infringement, and they will be forced to stop using it, and they will also be liable for compensation.

2. No matter whether the trademark applied for registration is actually used or not, as long as the trademark is approved for registration, it will be protected by law. Without consent or permission, others may not use it, otherwise it will be punished by law.

3. Where two or more identical or similar trademarks are used to apply for registration on the same or similar goods, and the Trademark Office approves the application first and then rejects it, if the application is filed on the same day, if it is approved, it will be used or not used on the same day, and the decision will be made through consultation. If negotiation fails, the Trademark Office shall draw lots for decision or ruling.

4. To apply for trademark registration, the applicant shall fill in the application form according to the categories and names stipulated in the international classification of the Nice Agreement, apply according to the categories, and pay the fees. If it is a new commodity or service, an explanation should be attached.
