Regulations of the People's Republic of China on Administrative Penalties for Public Security

Article 1 These Regulations are formulated in accordance with the spirit of Article 49, Item 12 and Article 100 of the Constitution of People's Republic of China (PRC). Article 2 Whoever disturbs public order, endangers public safety, infringes on citizens' personal rights and damages public or private property, which is not serious enough for criminal punishment and should be punished in accordance with these regulations, is an act of violating public security administration.

People's Republic of China (PRC) citizens and foreigners who violate the administration of public security shall be dealt with in accordance with these regulations. Article 3 Penalties for violating the administration of public security are divided into the following three categories:

First, a warning.

2. Fine: 50 cents to 20 yuan; The aggravated punishment shall not exceed thirty yuan.

The fine shall be paid within five days after the ruling; Those who fail to pay within the time limit shall be detained.

3. Detention: more than half a day and less than ten days; The aggravated punishment shall not exceed fifteen days.

During the detention, the detainee's food expenses shall be borne by himself; If you can't afford the meal, you can use labor instead. Article 4 Instruments violating the administration of public security must be confiscated.

Property obtained due to acts violating the administration of public security shall be confiscated.

The above-mentioned appliances and property, except prohibited items, have been returned to their original owners. Article 5 Whoever commits one of the following acts that disturb public order shall be detained for not more than ten days, fined not more than twenty yuan or given a warning:

1. Group fight;

2. Disturbing the order of stations, docks, civil aviation stations, parks, shopping malls, casinos, exhibitions, sports grounds or other public places, and refusing to listen to dissuasion;

3. Disrupting the office order of state organs and refusing to listen to dissuasion;

4. Refusing or obstructing the state security management personnel from performing their duties according to law, and failing to reach the level of violent resistance;

5. Damaging notices and seals that are still valid by state organs;

Six, defacing places of interest or buildings of political significance;

Seven, the sale and rental of reactionary, obscene and absurd books, albums and pictures that have been banned;

Eight, in violation of the government's order prohibiting prostitution, whoring or whoring. Article 6 Whoever commits one of the following acts disturbing public order shall be detained for not more than seven days, fined not more than fourteen yuan or given a warning:

First, gambling property, education does not change;

Two, the use of lottery, lottery or other methods of gambling in disguise, after education;

(3) spreading rumors to mislead people, defrauding a small amount of property or affecting production, which is ineffective after education;

4. Carving the official seal without permission, forging or altering the certificate, if the circumstances are minor;

Five, printing lettering industry to undertake official seals or other documents, in violation of management regulations;

Six, the sale of counterfeit drugs, defrauding a small amount of money. Article 7 Whoever commits any of the following acts that disturb public order shall be detained for not more than three days, fined not more than six yuan or given a warning:

1. Fishing and hunting in prohibited fishing and hunting areas and refusing to listen to dissuasion;

Two, photography, surveying and mapping in the forbidden area, do not listen to discourage;

Three, in the forbidden area, unauthorized passage, do not listen to discourage;

Four, damage or unauthorized movement of temporary surveying markers;

Five, arbitrarily issuing loud noises in the city, affecting the work and rest of the surrounding residents, not listening to stop. Article 8 Whoever commits one of the following acts endangering public security shall be detained for not more than seven days, fined not more than fourteen yuan or given a warning:

1. Digging holes or placing obstacles on railways and highways is not enough to make vehicles run dangerously;

2. Throwing stones, mud blocks or other similar items at trains, cars and ships;

Three, damage to traffic signs or other traffic safety equipment;

4. Damaging street lamps;

Five, manufacturing, storage, transportation, use of explosives, flammable chemicals, does not meet the safety regulations;

Six, the manufacture, purchase, storage and use of highly toxic substances, which do not meet the safety regulations;

Seven, in violation of fire rules and regulations, improved requirements, refused to implement;

Eight, damage to fire equipment or fire tools;

Nine, unauthorized use of public fire fighting equipment and fire fighting tools for other purposes;

Ten, without the permission of the local government, burning mountains, burning wasteland, has not caused disasters;

Eleven, the fire destroyed state property, cooperative property or other people's property, but has not caused serious losses. Article 9 Whoever commits one of the following acts endangering public security shall be detained for not more than five days, fined not more than ten yuan or given a warning:

1. Without the permission of the government, buying and holding sports guns and ammunition or keeping and using them that do not meet the safety requirements;

Two, without the permission of the government, manufacturing, purchasing, holding a shotgun or opening a workshop to repair the shotgun;

3. Setting up and using a civil shooting range that does not meet the safety requirements;

Four, the installation and use of power grid, does not meet the safety regulations;

Five, organize mass gatherings, do not take corresponding safety measures, there is a danger of personal injury, it is pointed out that no improvement;

Six, the ferry is overloaded, or the hull is damaged and in danger of sinking, and it is urged to continue to use without repair;

Seven, in case of strong winds, floods and shipwreck danger, forced ferry, do not listen to stop;

Eight, scrambling to board the ferry, do not listen to stop, or force the ferry driver to overload the ferry;

Nine, * * * public places of entertainment over-quota ticket sales may cause accidents, do not listen to discourage;

Ten, public * * * casino in business hours, did not keep the entrance and exit open.
