Subscription fund
Subscription refers to the behavior of developers to let buyers pay subscription fees through some concessions before formal sales. According to the regulations, any form of subscription is an illegal act of the developer before obtaining the pre-sale permit, which is explicitly prohibited by the state.
"Subscription" is an exotic product, inspired by a speculative way in Hong Kong's real estate market. "Subscription" means that buyers show their sincerity in buying a house, which needs to be reflected by paying "subscription money". After paying the "subscription fee", buyers can get the preemptive right of the house and enjoy a certain degree of price concessions. When the real estate is officially opened for sale, the "recognized" buyers will choose houses in the order of "priority", and after choosing houses, they will sign formal housing sales contracts with developers. If the buyer does not choose the ideal house, the developer will return the "subscription money" to the buyer in full.
The "subscription fund" seems reasonable, which can not only ensure that buyers have priority in choosing houses, but also "full refund" will not cause any losses to buyers who give up the idea of buying houses. However, behind this system, there are many unexpected and huge risks for property buyers. "Recognition" means "sleepy".
subscription fee
Subscription money is money paid at the time of subscription. After the subscription money is paid, the developer will promise not to sell the house to a third party other than the subscriber for a certain period of time, and the subscriber promises to negotiate with the developer on the purchase of the house according to the terms agreed in the agreement during this period. The buyer obtains the preemptive right within this period by paying the subscription money, and the seller shall not sell the house to others within the agreed time. If the buyer decides not to buy, the seller shall refund the subscription money; However, if the buyer decides not to buy after the specified time limit, the subscription money will be used as compensation for the loss during the seller's reservation of the room number and will not be returned to the buyer.
After paying the subscription fee, what if the developer doesn't open the market and doesn't refund the money?
Property buyers fill in personal data in the project marketing center before the opening, and then pay different amounts of "sincerity money" to obtain VIP cards or subscription cards. After getting it, you are eligible to subscribe and have the priority to choose a house. But generally speaking, the number of qualified buyers exceeds the actual number of properties launched. In this case, the developer will take the form of lottery or lottery to re-select a group of buyers. Then choose the floor room number and agree to sign the subscription book or subscription contract.
In the first case, if you pay the subscription money during the activity, but later don't want to buy a house because you or the developer didn't get the pre-sale permit for commercial housing, you can negotiate with the staff. If you don't return it, you can complain directly to the industrial and commercial bureau. Because the fund-raising activities are not recognized by the Housing Authority and are illegal, they will be returned.
In the second case, if you pay the subscription fee during the activity, you don't want the house. It is difficult to get a refund at this time, but it is also possible. Don't give up easily.
First, for example, a developer can't open a commercial house without a pre-sale permit and can ask for a refund. After all, it is not illegal, but it is already suspected of breaking the law.
Second, the developer's documents are complete, and the fact that you and the developer agreed to subscribe is a bit difficult to refund. The subscription fee is equivalent to the deposit. If one party breaches the contract, it does have the right not to refund. At this time, developers can actually stand still, because the subscription agreement is also a formal legal document, so it is more difficult to get it back. The premise that the developer does not return is "once the online housing selection is successful". If you do not participate in the housing selection or choose your own house, it should be another matter.
