How to go to the court to auction the car process?

1. Evaluate the price. Before the property seized, detained or frozen by the person subjected to execution is realized, the court shall entrust a legally established and qualified asset appraisal institution to conduct price appraisal;

2. Make a decision on compulsory auction. After the price evaluation is completed, the court may organize the parties to negotiate and pay off the property of the person subjected to execution to the applicant for enforcement according to the evaluated price. If the parties fail to reach an agreement on paying debts in kind, the court shall make a decision on compulsory auction of the property of the person subjected to execution.

3. The determination and entrustment of auction institutions and the selection of auction institutions shall be handled in accordance with the relevant provisions of the Supreme Court and made by the technical department of the court;

4. After accepting the entrustment of the court, the auction institution will announce and display the auction in strict accordance with the law and the contract;

5. Determine the auction floor price. Before the auction is held, the court shall determine the auction reserve price according to the evaluation price and inform the auction institution;

6. Hold an auction. When an auction is held, the court should generally send personnel to supervise the auction and record the auction. Auction institutions may also invite notaries to be present for notarization.

7. Confirm that the auction is over.

Legal basis: Article 11 of the Provisions of the Supreme People's Court on Auction and Sale of Property in Civil Execution by People's Courts.

The people's court shall, five days before the auction, notify the parties concerned and the known holders of security interests, preemptive rights or other priority persons to be present on the auction day in writing or in other appropriate ways that can confirm receipt.

If the preemptive right holder is not present after the notice, it shall be deemed as giving up the preemptive right.

In the auction process, when the highest bid appears, the preemptive right holder can say that he will buy at the highest price; If there is no higher bid, it will be returned to the preemptive right holder; If there is a higher bid, but the preemptive right holder does not express it, it will be auctioned to the bidder with the highest bid.

If multiple preemptive rights holders in the same order express their acceptance at the same time, the buyer shall be determined by drawing lots.
