When the debtor fails to perform the loan contract or pay off the debt, the creditor applies to the court for compulsory execution through judicial procedures, and auctions the house under the debtor's name to pay off the creditor's rights with the proceeds from the auction. The house being auctioned in this process is the auction house. According to the law, before the expiration of the performance period, if one party explicitly expresses or shows by its own behavior that it will not perform the main debt, or if one party delays the performance of the main debt and fails to perform it within a reasonable period after being urged, so that the purpose of the contract cannot be achieved, the other party may request to terminate the contract. And may require the breaching party to compensate for the losses. Therefore, if the original owner still does not assist in the transfer formalities after being urged, as the buyer, he can request to terminate the house sales contract and ask the other party to compensate for the losses.

In the auction process, when the highest bid appears, the preemptive right holder can say that he will buy at the highest price; If there is no higher bid, it will be returned to the preemptive right holder; If there is a higher bid, but the preemptive right holder does not express it, it will be auctioned to the bidder with the highest bid.
If multiple preemptive rights holders in the same order express their acceptance at the same time, the buyer shall be determined by drawing lots.

When auctioning a number of properties, if the sale price of some of them is enough to pay off debts and pay the expenses that the person subjected to execution should bear, the auction of the remaining properties shall be stopped, unless the person subjected to execution agrees to auction them all.
