After the owner arrives at the community, he finds that the following questions do not meet the premise of handing over the house, and you need to give a clear answer before handing over the house.
1. The commercial housing sales contract promises that the residential pipeline gas, one of the three links, has not been opened when the house is handed over.
1, please clearly answer the connection time between Dongfang New Town and the main pipeline and the delivery date of pipeline gas.
Xiang' an gas pipeline is not connected, and the owner contacts China Resources Gas Company by himself.
2. Please make it clear that the cost of opening pipeline gas in Dongfang New Town will not be borne by the owner in the future.
The relevant expenses shall be borne by the owner.
Second, the basic facilities of the community are not perfect.
1, there is no basic fitness equipment in the community. Please give a clear answer to the installation and delivery date of fitness equipment.
There is no fitness equipment in the community planning.
2. There is no public lounge chair in the community. Please give us a definite answer on the date of installation and delivery.
There are no rest seats in the community planning.
Third, the quality of public security doors is seriously unqualified.
1, at present, the quality of the residential security door is seriously unqualified, it does not have the basic security and anti-theft function, and it can't even be opened and closed normally, which will definitely affect the safety and convenience of the owners in the future. Now your company is required to replace it with a product with anti-theft function and qualified quality. It is strongly required to have the function of pull back rod and electronic lock.
The tie rod will be installed, but the door will not be replaced.
2. For some corridors with windows on the first floor, anti-theft nets are needed; The door of the terrace on the top floor is replaced by a safety door with qualified quality and anti-theft function; Ensure the minimum safety of the owner.
A row of security nets will be installed on the first floor near the hotel.
Fourth, illegally opening private clinics in the community.
The relevant laws expressly stipulate that commercial operations are not allowed in residential buildings, not to mention such private clinics that affect the safety of community owners. At present, Hongwu Orthopedic Clinic, which has been illegally set up in the residential area before handing over the house, hopes that the developer will retire according to law before handing over the house to ensure the standardization of the community and the safety of the owners.
Opening a clinic is for the owner. If there is any violation of relevant regulations, please find the relevant department to deal with it.
Five, without the consent of all owners to change the planning and design of the community.
1 Without the consent of all the owners, change the planning and design without authorization, and change the original 4 100 square meter building of the owner's activity center into a business hotel. Now your company is required to show the change documents signed and agreed by the planning department to prove its legality, and there must be sufficient reasons to prove that the building is not included in the pool area of the community. According to relevant laws, if the registered area of property rights is less than the area agreed in the contract, the part of the house price with an area error ratio exceeding 3% will be returned by the developer twice.
2. If the planning of the hotel is changed to be legal, the developer is required to reasonably solve the inconvenience caused by the compression of the owner's activity space of 4 100 square meters in this residential area due to this design change until all the owners are satisfied.
3. Please announce the ownership and legal transaction documents of the underground parking garage originally defined by all owners under the building of 4 100 square meters in the owner's activity center. Relevant laws clearly stipulate that the garage in the community should give priority to meeting the needs of the owners. Now it has been privately occupied by a hotel without the consent of the owner. Now developers are required to give all owners a reasonable explanation until they are satisfied.
Six, there are serious problems in the quality of residential buildings.
1, garbage fillers such as jeans convenience bags appeared on the wall of the 4#2 floor of the residential area; In addition, many buildings in the residential area have sunk transverse fractures (cracks reach 1-2cm), and developers only use asphalt and cement to repair them. In this regard, we seriously question the quality and safety of the whole residential building, and ask the developer to let the authoritative organization and relevant departments re-evaluate the quality and safety of the whole residential building before handing over the house, and give authoritative documents to prove the safety of the residential building. And the treatment methods of quality and safety problems in similar situations in the future until the owner is satisfied.
2. Some manhole covers, walls and drip eaves in the residential area have been in disrepair for a long time, which has potential safety hazards. Please give a clear reply on the date of maintenance, rectification and improvement until all owners are satisfied.
The damaged manhole cover will be repaired.
In view of the above problems, please ask Xiang 'an Construction Development Real Estate Co., Ltd. to give a written reply to all the owners within two working days, and both parties will reach a written agreement on the solution and time limit. If your company does not rectify the above problems, we refuse to accept the house, and file an administrative reconsideration with the relevant government departments, and reserve the right to bring a lawsuit to the people's court; For the owners who have already delivered the house, they also reserve the right to pursue all legal responsibilities of the developer. As a result, the owner can't move in on schedule, and the serious consequences of the problem, all economic losses, liabilities for breach of contract and all legal responsibilities caused by this will be borne by your company.
Please reply to the prospective owner within two working days, otherwise, it will be deemed that you agree with the above facts stated by the prospective owner and agree with the rectification opinions of the prospective owner. This letter will be sent to the notary service without your receipt.
