In order to attract customers and increase product sales, some merchants will set some prizes and carry out sales activities with prizes. However, in order to avoid unfair competition and market imbalance, China has also stipulated the upper limit of prizes. Among them, the law clearly stipulates that the maximum bonus for sales with prizes cannot exceed 5,000 yuan. In fact, the understanding that the maximum cannot exceed 5,000 yuan can really be 5,000 yuan. Moreover, it is aimed at one shopping and one lottery, not including the situation that multiple shopping and multiple lottery have accumulated more than 5,000 yuan. Moreover, in practice, there are mainly two kinds of bonus sales: 1, and bonus sales refer to the gift behavior attached to or attached to the sales behavior. In fact, gift sale is a kind of gift, that is, merchants give property or property-related rights to consumers for free. 2. Lottery-based prize-winning sales is a kind of prize-winning sales method that decides whether the buyer wins the prize by accidental means such as lottery and lottery. Usually, consumers can get prizes without any rewards, which is the so-called prize sales. In fact, most of them will be considered as unfair competition. In addition, the law also explicitly prohibits the following cheating behaviors of prize sales, which also needs attention: 1, falsely claiming that there is prize sales or making false representations about the category, winning probability, maximum prize amount, total amount, category, quantity, quality and delivery method of prizes. 2. Take improper means to deliberately let the default personnel win the prize. 3. Deliberately not putting commodities and lottery tickets with winning marks on the market or not putting them on the market at the same time as commodities and lottery tickets; Deliberately put commodities and lottery tickets with different bonus amounts or prizes on the market at different times. 4. Other awards cheat sales. Finally, in order to increase sales, many businesses now use various methods to sell. Bonus sales is undoubtedly one of the most useful methods, and it is also easier to be deceived, resulting in property losses in this area.
Legal objectivity:
At present, merchants constantly use prize-winning sales in promotional activities to stimulate consumption, while consumers often take chances when buying goods, hoping that the goods they buy are not only worth the money, but also get unexpected gains. Therefore, we can often see that people's purchasing power is particularly strong in the days when department stores hold prize-winning sales activities, and shops are also smiling and beaming. However, with it, consumers began to feel cheated. So, does the law stipulate that there is a prize sale? The law prohibits three kinds of sales with prizes. Article 13 of the Anti-Unfair Competition Law stipulates: "Operators shall not engage in the following sales with prizes: (1) sales with prizes that deceive others or intentionally let the defaulting personnel win prizes; (two) the use of prize-winning sales means to promote the quality of goods at a high price; (3) sales by lottery with prizes, with the highest prize amount exceeding 5,000 yuan. " Therefore, if consumers find that the seller has the above-mentioned behaviors in participating in the prize-winning sales activities, they can conclude that the seller has violated the law, deceiving consumers, damaging consumers and harming consumers' interests.
