Chapter I General Provisions
Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of owners and property service enterprises, improve the level of property management, promote the healthy development of the property management industry, and create a harmonious, safe, civilized and tidy living and working environment, these Measures are formulated in accordance with the People's Republic of China (PRC) Property Law, the the State Council Property Management Regulations, the Guangdong Property Management Regulations and other laws and regulations, combined with the actual situation of this Municipality.
Article 2 These Measures shall apply to the property management activities within the administrative area of this Municipality. In the following words? City? Refers to Zhaoqing City, and counties (cities, districts) refer to counties, cities and districts under the jurisdiction of this Municipality (including Zhaoqing High-tech Zone and Zhaoqing New District).
The term "property management" as mentioned in these Measures refers to the activities of the owners to maintain, conserve and manage the houses, supporting facilities, equipment and related sites by hiring property service enterprises, and to maintain the environmental sanitation and related order in the property management area.
According to the contract or the owner's own management, the owner carries out maintenance, conservation and management of the houses, supporting facilities, equipment and related sites in the property management area, and maintains the environmental sanitation and order in the relevant areas. , should be implemented with reference to these measures.
Third city housing and urban and rural construction administrative departments to organize the implementation of these measures, responsible for the supervision and management of property management activities in the city. Counties (cities, districts) housing and urban and rural construction administrative departments responsible for the supervision and management of property management activities in this area.
Neighborhood offices and Township People's governments shall, jointly with the administrative departments of housing and urban and rural construction of counties (cities, districts), guide and assist the establishment of owners' congresses and the election of owners' committees within their respective jurisdictions, supervise the daily activities of owners' congresses, owners' committees and property service enterprises, and mediate and handle property management disputes.
Residents' committees and villagers' committees shall establish a coordination mechanism between owners, owners' committees and property service enterprises, and assist neighborhood offices and township people's governments in guiding and supervising community property management activities.
County (city, district) housing and urban and rural construction administrative departments and neighborhood offices, Township People's governments shall organize publicity and education of property management laws, regulations, rules and normative documents, and enhance the owners' ability and awareness of self-management.
The competent department of urban and rural planning administration shall be responsible for the allocation of various public facilities in accordance with the provisions when determining the planning conditions of real estate projects; When approving the construction project planning permit, clarify the location and area of the property service room; And do a good job in the property management area according to functions and responsibilities.
The price administrative department shall be responsible for formulating the charging standards for property services in the early stage of the property management area; Standardize all kinds of fees in property management activities, accept price consultation and complaints, and investigate and deal with relevant price violations.
The public security administrative department is responsible for guiding the implementation of the construction and management of safety facilities in the property management area, guiding and urging property service enterprises and order maintainers to carry out safety work, eliminating potential safety hazards in the property management area, promptly investigating and handling public security cases, and mediating various contradictions involving public security management; Responsible for taking relevant measures in accordance with the law for traffic jams in the property management area.
Urban management, environmental protection, fire protection, justice, industry and commerce, taxation, city appearance and sanitation, water supply, drainage, power supply, gas supply, cable television, communications and other relevant departments and units shall, according to their respective responsibilities, do a good job in the relevant work within the property management area.
Article 4 Residents' committees, villagers' committees, owners' congresses, owners' committees and trade associations (special committees) shall, within their respective functions and duties, do a good job in the relevant work within the property management area.
(a) the residents' committees and villagers' committees shall actively do a good job in the social affairs management of the property management community in this region, promote the close cooperation between the owners and the property service enterprises, and build a harmonious interpersonal relationship in the community. Cooperate with neighborhood offices and township people's governments to give guidance and help to the establishment of owners' congress and the election of owners' committee, and coordinate and handle disputes in property management.
(two) the owners' congress and the owners' committee shall perform their autonomous management duties according to law, and support and cooperate with the residents' committees and villagers' committees to carry out their work; Coordinate the handling of complaints from owners and non-owners about property services.
(3) Property management industry associations (special committees) shall strengthen the self-discipline management of the industry according to law, formulate a convention on honesty and self-discipline management of the property management industry, maintain market order and fair competition, and promote the management and service of property service enterprises according to law; Responsible for publicizing the laws, regulations and rules of property management services, organizing employees in the property service industry to carry out business training, giving informed criticism and publicly condemning acts that violate laws, regulations and industry norms, mediating internal disputes in the industry and promoting the healthy development of the industry.
Fifth, establish a joint meeting system for property management. Neighborhood offices and township people's governments are responsible for convening, and the county (city, district) housing and urban-rural construction administrative departments, price administrative departments, public security police stations, residents' committees, villagers' committees, property service enterprises, owners' committees or owners' representatives participate. , coordinate and solve major problems in property management within their respective jurisdictions.
The joint meeting of property management mainly coordinates and solves the following matters:
(a) the owners' committee fails to perform its duties according to law;
(two) the problems in the process of the change of the owners' committee;
(three) major issues in the performance of the property service contract;
(four) the problem of premature termination of the property service contract;
(five) problems in the process of withdrawal and handover of property service enterprises;
(six) other property management issues that need to be coordinated and solved.
Article 6 People's governments at all levels shall support the development of the property management industry, actively promote the process of industrialization, specialization, socialization and marketization of property management, encourage the innovation of property management mechanism, and improve the service level of property by relying on scientific and technological progress.
Chapter II Property Management Areas
Seventh property management area according to the red line map determined by the property construction land planning permit, combined with the * * * of the property construction equipment, community construction and other factors to determine. If the property is developed and built by stages or by more than two construction units, and its supporting facilities and equipment are used, it shall be designated as a property management area; However, facilities and equipment can be used independently and divided into different property management areas.
In the old cities, villages in the city and other built residential areas where property management has not been implemented, the subdistrict offices and township people's governments shall determine the property management areas after consulting the relevant owners.
Where the delineation of the property management area is controversial, the administrative department of housing and urban and rural construction of the county (city, district) people's government where the property is located shall solicit the opinions of the neighborhood offices, township people's governments, relevant owners, residents' committees and villagers' committees where the property is located.
Article 8 Construction units, realty service enterprises, subdistrict offices and township people's governments shall, in accordance with the provisions of Articles 9 to 11 of these Measures, apply to the administrative department of housing and urban and rural construction of the people's government of the county (city, district) where the property is located for the filing procedures of the property management area. If the submitted materials are complete and meet the statutory requirements, the administrative department shall issue a written record receipt stamped with the seal within seven days from the date of receiving the record application.
Article 9 The construction unit shall submit the following materials and go through the filing procedures for the property management area before the preliminary bidding for property management begins:
(a) the "property management area filing declaration form";
(two) the business license of the construction unit;
(three) the "construction land planning permit" and the attached drawings;
(four) the detailed planning of the construction project and the general plan of the design scheme of the construction project after examination and approval;
(five) to predict or measure the property management houses allocated in the property management area;
(6) Official documents of place names.
Tenth has implemented the property management of the completed residential area, not for the property management area filing procedures, the property service enterprise shall submit the following materials:
(a) the "property management area filing declaration form";
(2) Property service contracts;
(three) the qualification certificate of the property service enterprise;
(four) the "construction land planning permit" and the attached drawings;
(five) the detailed planning of the construction project and the general plan of the design scheme of the construction project after examination and approval;
(six) the location and construction area of the property management house;
(seven) the official documents of place names.
Due to the non-existence of the construction unit or other objective reasons, the realty service enterprise is unable to provide the information in Items (4) to (6) of the preceding paragraph, and the realty service enterprise shall report in writing the four boundaries of the area where property management has been implemented, the use of property facilities and equipment, and the construction of the community.
Article 11 Where the built residential areas such as old urban areas and villages in the city that have not implemented property management need property management, the subdistrict offices and township people's governments shall, after determining the property management areas, submit the following materials and go through the formalities for filing the property management areas:
(a) the "property management area filing declaration form";
(two) the regional map of property management;
(3) Determine the opinions of the property management area.
The contents of the opinions determined in Item (3) of the preceding paragraph shall include the four areas of the area, the use of facilities and equipment of the property, and the construction of the community.
Twelfth new property for sale, the construction unit shall record the property management area in the commercial housing sales contract.
In the' built residential area' where property management has been implemented, the property service enterprise or the sub-district office and the Township People's Government shall announce all the owners of the registered property management area in a prominent position in the property management area.

Chapter III Owners, Owners' Congress and Owners' Committee
Article 14 The owner of a house is the owner.
A person who has not obtained the ownership by registration, but legally occupies the house on the basis of legal acts aimed at transferring the ownership, such as buying and selling, giving gifts and compensation for demolition, enjoys the rights of the owner stipulated by laws and regulations in property management activities, and undertakes corresponding obligations.
Fifteenth owners set up the owners' meeting according to law, and elected the owners' committee.
The owners' congress is composed of all owners in the property management area, representing and safeguarding the legitimate rights and interests of all owners in property management activities, and performing their duties according to law.
If the number of owners in a property management area is small and it is decided not to set up an owners' meeting with the unanimous consent of all owners, the owners shall perform the duties of the owners' meeting and the owners' committee.
Article 16 Where the construction area of the delivered property reaches 50% of the construction area of the property management area, the construction unit shall report in writing to the neighborhood offices and township people's governments where the property is located, and make an announcement in a prominent position in the property management area.
Seventeenth more than twenty percent of the owners can jointly submit a written request for the establishment of the owners' meeting to the sub-district office and the Township People's government.
If the delivered building area of the property reaches 50% of the building area of the property management area or the pre-developed part of the building area, the owners may submit a written request for the establishment of the owners' meeting to the subdistrict office and the Township People's Government.
Under any of the circumstances mentioned in the preceding two paragraphs, the subdistrict office and the Township People's Government shall, within seven days after receiving the written application, announce the notice of the establishment of the preparatory group in a prominent position in the property management area in written form, and inform all the owners to prepare for the establishment of the first owners' meeting. The announcement time shall not be less than seven days, and the contents of the announcement shall include the conditions of the owner's representative, the way of production, and the way and time limit for the owner to submit information.
Article 18 Sub-district offices and township people's governments shall, within 30 days, jointly with the administrative departments of housing and urban and rural construction of the people's governments of counties (cities, districts) where the property is located, guide and assist the owners to recommend and produce the preparatory group for the owners' meeting. The preparatory group for the owners' meeting is composed of seven to fifteen (odd) representatives from the owners' representatives, the construction unit, the subdistrict office and the township people's government, among which the owners' representatives shall be no less than 60% of the number of the preparatory group for the first owners' meeting.
Representatives of the owners of the preparatory group shall be jointly recommended by the owners and determined according to the ranking order of the recommended number; If the number of referees is the same, the ranking order can be decided by drawing lots.
Neighborhood offices and Township People's governments shall notify the construction unit in writing to entrust representatives to participate in the work of the preparatory group. If the construction unit does not participate in the work of the preparatory group or does not exist, it shall be regarded as giving up.
