The term "nearby resettlement" as mentioned in these Provisions refers to the resettlement site 4 to 8 kilometers away from the relocation site (excluding 4 kilometers).
The term "local resettlement" as mentioned in these Provisions refers to the resettlement place within 4 kilometers (including 4 kilometers) from the relocation place.
The term "transitional housing" as mentioned in these Provisions refers to the temporary housing provided by residents or solved by themselves before moving into resettlement houses. Article 4 The compensation and resettlement for demolition in the reconstruction area of Xiahe Road shall be handled in accordance with the relevant provisions of Chapters III and IV of the Regulations and Chapters III and IV of the Measures, and may be given appropriate encouragement in accordance with the following provisions:
(a) when moving, the relocation of people to provide transitional housing, according to the following provisions:
(1) If the users of demolished public housing (including self-run housing) reach a relocation agreement within the period of demolition announcement, the resettlement housing standard shall be calculated according to the per capita housing construction area 17 m2 -22 m2 (2 m2 more than the upper and lower limits stipulated in the Measures); If the user completes the relocation within the prescribed time limit or the agreed time limit (hereinafter referred to as early relocation), the demolisher will give a one-time reward to 30 yuan per person per day.
(two) the owner and user of the demolished private house belong to the same person, and the owner of the private house requests the property right exchange, and reaches a compensation agreement for the demolition and resettlement within the period of the demolition announcement. If the demolished person moves more than 15 days in advance, the price difference of the same area will be paid at one time for property right exchange, and 70% preferential relief will be given; The part of the resettlement house with property right exchange exceeding the construction area should make up the difference.
(3) The owner and user of the demolished private house belong to two people, and the owner of the private house requests to retain all the property rights, but the owner and user still maintain the lease relationship and reach an agreement on compensation and resettlement for demolition within the period of the demolition announcement. If the demolished person moves more than 15 days in advance, the price difference of the same area will be paid in one lump sum for property right exchange, and all benefits will be exempted; Property rights exchange resettlement housing over the construction area of the part should pay the price difference; If the user moves ahead of schedule, the demolisher will give a one-time reward of 30 yuan per person per day.
(4) If the owner of the demolished private house gives up the property right and asks for the resettlement of the demolished person, and an agreement on compensation and resettlement for the demolition is reached within the period of the demolition announcement, the resettlement housing standard shall be calculated according to the per capita housing construction area 17 square meters -22 square meters (2 square meters more than the upper and lower limits stipulated in the Measures); If the demolished person moves more than 15 days in advance, the demolished person will be compensated by increasing the total compensation of the original house by 30%.
(two) the nearest resettlement or local resettlement, provided by the demolition of transitional housing, according to the following provisions:
(1) If the users of demolished public housing (including self-run housing) reach a relocation agreement within the period of demolition announcement, the standard of resettlement housing shall be calculated according to the per capita construction area 15-20 square meters; Where the relocation is completed more than 5 days in advance, according to the serial number signed by the agreement, priority can be given to the location, floor and orientation of the resettlement house; And the demolition person will give each person a one-time reward of 100 yuan.
(2) The owner and user of the demolished private house belong to the same person, and the property rights are changed. If an agreement on compensation for demolition and resettlement is reached within the period of demolition announcement, and temporary transitional houses are relocated more than 5 days in advance, the location, floor and orientation of resettlement houses can be given priority according to the serial number signed by the agreement. If the price difference of the property right exchange and the total price of the over-sized part are paid in one lump sum, the preferential payment will be reduced by 25%.
(3) The owner and user of the demolished private house belong to two people, and the owner of the private house requests to keep all the property rights of the self-occupied and leased parts, and the owner and user continue to maintain the lease relationship. Within the period of the demolition announcement, if an agreement on compensation for demolition and resettlement is reached, and the temporary transitional housing is moved more than 5 days in advance, the same area price difference and the total price of the part beyond the area (below 5 square meters) will be paid in one lump sum, with a preferential reduction of 30%.
(3) If the relocated people solve the transitional housing by themselves, reach a compensation agreement for relocation within the period of the demolition announcement, and complete the relocation more than 5 days in advance, they will be given RMB 1 000 per person at one time. Belong to the local nearest resettlement, and then a one-time reward of RMB 600 yuan per person.
(4) If the private house to be demolished is an overseas Chinese house, it shall be handled in accordance with the relevant provisions of the Measures of Fujian Province for the Implementation of the Law on the Protection of the Rights and Interests of Returned Overseas Chinese and Their Families in People's Republic of China (PRC):
(1) If the owners of overseas Chinese houses require local resettlement, they shall be satisfied in principle.
(2) All overseas Chinese houses that meet the requirements of Document No.44 [1984] and Document No.44 [1988] 157 of the CPC Central Committee will be cleared away, and all the tenants will be provided with housing by the government; According to document [1988] 157, the right to use overseas Chinese houses "is generally not returned". If there are no tenants after demolition and resettlement at the request of the owner, the government or the demolisher can provide housing to resettle their tenants, but the owner must bear part of the cost of renting the house, and the income is calculated at RMB 540 yuan per square meter of construction area.
