Bonus sales mainly include bonus sales and lottery sales. Bonus sales refers to the gift behavior attached to or attached to the sales behavior. Bonus sale is actually a gift, that is, the owner gives the property or the rights related to the property to others for free. This kind of gift is closely related to market competition and should be regulated by competition law.
Lottery-based prize-winning sales is a kind of prize-winning sales method that decides whether the buyer wins the prize by lottery, lottery and other accidental means. As a means of promotion, prize-winning sales can increase the market share of related commodities, promote the circulation of commodities and bring certain economic benefits to operators. Lottery sales with prizes, if properly used, can play a positive role in activating the market and promoting competition; Improper use will destroy the competition order and harm the interests of consumers.
Article 10 of the Anti-Unfair Competition Law of People's Republic of China (PRC) shall not exist in the following circumstances when an operator conducts sales with prizes:
(1) The category of prizes, redemption conditions, bonus amount or sales information of prizes are unclear, which affects the redemption;
(2) Selling with prizes by fraudulent means such as lying about winning a prize or intentionally letting the defaulting personnel win a prize;
(three) the sale of lottery tickets, the maximum bonus amount of more than fifty thousand yuan.
Article 12 Operators engaged in production and business operations through the Internet shall abide by the provisions of this Law.
Operators shall not use technical means, by influencing users' choices or by other means, to carry out the following acts that hinder or undermine the normal operation of network products or services provided by other operators according to law:
(a) without the consent of other operators, insert links or force the target to jump in their legally provided network products or services;
(2) misleading, deceiving or forcing users to modify, shut down or uninstall network products or services legally provided by other operators;
(3) Malicious incompatibility with network products or services legally provided by other operators;
(four) other acts that hinder or destroy the normal operation of network products or services provided by other operators according to law.
