Article 18 The local people's government at or above the county level that has made the decision on house expropriation shall compensate the expropriated person in accordance with the provisions of these Regulations.
Nineteenth compensation methods can be monetary compensation, housing property rights exchange, or a combination of monetary compensation and housing property rights exchange. If the house is expropriated due to the renovation of dilapidated houses and residential construction is carried out, the expropriated person has the right to move back. In addition to the provisions of Article 29 of this Ordinance, the expropriated person may choose the compensation method.
Twentieth the amount of monetary compensation, according to the location, use, building structure, old and new degree, construction area and other factors, to determine the real estate market evaluation price. The real estate market appraisal price of the expropriated house shall be determined by a real estate appraisal agency with corresponding qualifications in accordance with the real estate appraisal norms and relevant regulations, but it shall not be lower than the market transaction price of similar real estate on the effective date of the house expropriation decision. The real estate price appraisal institution shall be determined by the expropriated person by voting and drawing lots.
Twenty-first real estate price appraisal institutions shall independently, objectively and fairly determine the real estate market appraisal price of the houses to be expropriated, and be responsible for the legality, authenticity and rationality of the appraisal report issued by them. The house expropriation department shall provide the real estate price appraisal institution with the survey results specified in the first paragraph of Article 24 of these regulations. No unit or individual may interfere in the compensation and appraisal work.
