Interim Provisions of Wuhan Municipality on Bidding, Evaluation and Calibration of Urban Landscaping Projects

In order to further standardize the bidding, bid evaluation and calibration of landscaping construction projects in our city, fully embody the principles of openness, fairness, impartiality and honesty, and improve the level of bidding management, according to the Construction Law of People's Republic of China (PRC), the Bidding Law of People's Republic of China (PRC), the Measures for the Administration of Bidding for Housing Construction and Municipal Infrastructure Construction (Decree No.89 of the Ministry of Construction) and the provincial and municipal governments.

I. Bidding

(1) Construction of construction projects

The procedures for applying for construction of landscaping construction projects shall be handled by the tenderee or his agent at Wuhan Landscaping Construction Management Station (hereinafter referred to as the Municipal Landscaping Construction Management Station). The application for project construction must meet the following conditions:

1, with the approved project plan approved;

2. There are legal documents for the use of land for construction projects;

3. Have a valid credit certificate issued by the bank.

(two) the application for bidding for construction projects

The tenderee holds the Application Form for Bidding of Construction Project to the Municipal Garden Construction Management Station to receive and fill in the Application Form for Bidding of Construction Project and apply for bidding.

The system of general contracting, professional contracting and labor subcontracting shall be implemented in the construction project of landscaping project, and the tenderee shall not dismember or subcontract the project.

A written application must be submitted separately for the landscaping construction project invited for bidding.

The tender application shall include the following contents:

1, name and document number of project plan approval;

2 project name, scale, investment, purpose and place;

3. The bidding method to be adopted and its reasons.

(three) to review the qualifications of the tenderer and the tender documents

The qualification examination of bidders and the examination of bidding documents shall be the responsibility of the municipal garden construction management station.

1 For the construction of landscaping projects that must be subject to construction bidding according to law, the tenderee shall have the ability to prepare bidding documents and organize bid evaluation.

(1) has a special construction bidding organization;

(2) There are professionals who are suitable for the scale and complexity of the project, have experience in bidding for similar projects, and are familiar with the engineering technology, budgetary estimate and project management of relevant laws and regulations on bidding for engineering construction.

If the above conditions are not met, the tenderer shall entrust a project bidding agency with corresponding qualifications to act as an agent for construction bidding.

2, landscape engineering construction project construction bidding must meet the following conditions:

(1) If the project examination and approval procedures need to be performed according to the relevant provisions of the state, the examination and approval procedures have been performed;

(2) the project funds or sources of funds have been implemented;

(3) There are design documents and other technical data that meet the needs of construction bidding;

(four) other conditions stipulated by laws, regulations and rules.

3. The tender documents shall be drafted and sealed by the tenderee or the tendering agency entrusted by the tenderee, and then sent to the municipal garden construction management station for examination and approval.

4. Pre-tender estimate must be compiled by an intermediary agency with engineering cost consulting qualification and having gone through the examination and approval procedures for engineering cost consulting business, and the basis for the valuation of engineering cost used by it should be the unified valuation standard issued by the relevant administrative departments of the state, province and city; Otherwise, it is an invalid pre-tender estimate.

(four) release the tender information

Approved by the Municipal Bureau of Gardens, it is an open tender project, and the bidding information is released simultaneously through the big screen of the "Municipal Construction Engineering Trading Center" and the website of the Municipal Bureau of Gardens. From the release of information to the end of registration, it shall not be less than 72 hours.

(five) open tender registration

According to the requirements of public bidding information, bidders should register with the tenderee at the designated time and place or on the website of the Municipal Bureau of Landscape Architecture. (Website of Municipal Bureau of Landscape Architecture:)

(6) Conditions of Bidder

The bidder shall meet the following conditions:

1, legal person or other organization established according to law;

2, with the national and provincial construction administrative departments approved by the landscaping construction enterprise qualification certificate and the industrial and commercial business license issued by the administrative department for Industry and commerce;

3, has been registered in the city garden construction management station;

4. Have the ability to prepare bidding documents.

Second, bid evaluation

(a) the bid evaluation committee

Establishment of bid evaluation committee

1. The bid evaluation committee is a temporary organization established by the tenderee under the supervision of the municipal garden construction management station to be responsible for bidding and bid evaluation.

2. The bid evaluation committee consists of representatives recommended by the tenderer and judges randomly selected from the judges' library.

3. The convener of the bid evaluation committee is the tenderer.

Composition of judges

1, the composition of the judges should meet the requirements of the project category and specialty.

2. The number of people recommended by the tenderer to participate in the bid evaluation committee shall not exceed one third of the total number of the bid evaluation committee; The number of judges produced in the judges' library is not less than two-thirds of the total number of bid evaluation committees. The number of judges must be an odd number of not less than 5.

3, the judges and their qualification management in accordance with the "Wuhan landscaping project construction project evaluation judges management implementation measures".

(2) principles and procedures of bid evaluation

Bid evaluation principle

Competitive selection; Fair, just, scientific and reasonable; Good engineering quality and high social reputation; The price is reasonable, the construction period is suitable, and the construction scheme is advanced and feasible; Oppose unfair competition.

Bid evaluation procedure

1, bid opening

(1) The tenderee introduces the tenderers and the staff of the municipal garden construction management station;

(2) Check whether the bidding documents conform to the regulations in public, and unseal the bidding documents according to the regulations;

(3) the bidding price, construction period, quality requirements, the amount of main materials and the contents that need special instructions;

(4) The published pre-tender estimate is consistent with the pre-tender estimate;

(5) The tenderee shall fill in the bid opening list and sign it by the bidder.

2. Bid estimation

(1) The bid evaluation shall be conducted by the judges in strict accordance with the bidding documents, scoring methods and these Provisions;

(2) When evaluating bids, the judges should make an objective, fair and independent evaluation of the bidding documents, and should not consult with each other, copy from each other, influence each other, and be tendentious.

(3) Evaluation index setting

Evaluation indicators generally include bid quotation, equipment provided by the project management department, construction organization design, bidding period, project quality and civilized construction safety production target, and bid rating. These indicators are calculated with a percentage system.

Tender offer K 1 (out of 42 points)

In bid evaluation, the bid evaluation price is taken as the scale, and the fluctuation range is within the range of +5% to -7%, which is the effective tender offer; If the bid price is out of range, the score is 0.

1, bid evaluation price

The bid evaluation price can be determined by the following two methods:

(1) If a project subject to tender has a pre-tender price, the pre-tender price shall be taken as the scale, and the budget price with a floating range of +4% to -4% shall be the effective budget price; If the bidder's budget price exceeds this range, it will not participate in the calculation of bid evaluation price.

The evaluation price calculation formula is divided into two types:

(1) q = 0.3 × base price +0.7×A a.

② Q=0.2× pre-tender estimate +0.8×A a.

Where: A—— the average value of the bidder's effective budget price.

The formula for calculating the bid evaluation price of a project subject to tender shall be determined by drawing lots when opening bids.

(2) If there is no pre-tender estimate for a project subject to tender, the bid evaluation price shall be included in the budget price of all bidders.

Arithmetic average after removing the highest and lowest budget prices.

If there are less than five bidders, the bid evaluation price shall be determined according to the first method in principle.

2. Scoring evaluation criteria

(1) If the bid quotation is within the effective range, the score is basically 32 points.

(2) Based on the bid evaluation price:

A. If the bid price is within the range of +5% to -5%, 2 points will be deducted for each bid price higher than 1%, and at most 10 points will be deducted; Every time it is lower than the bid evaluation price 1%, 2 points will be added, with the highest score of 10. The scoring formula is:

k 1 = 32+[(Q—Q)/Q]× 100×2(22≤k 1≤42);

B. If the bid price is in the range of -5% to -7%, the score will decrease from 42 points. The calculation formula is:

k 1 = 42—{[(Q—Q)/Q]—0.05 }× 100×5(32≤k 1≤42);

In the above formula:

Q- tender offer;

Q—— Bid evaluation price.

The project manager department is equipped with K2 (out of 8).

1. If the project manager to be dispatched by the bidder has the qualification registration certificate of the project manager corresponding to the project subject to tender, and it is specified that only one project is undertaken or there are special circumstances, and only two projects are undertaken at the same time (nearby), score 2 points; Otherwise, get 0 points;

2. If the project manager to be dispatched by the bidder has the first-class qualification, it will get 3 points, the second-class qualification will get 2 points, and the third-class qualification will get 1 point;

3. If the project management team is well organized, with clear responsibilities, complete personnel and professional support, and meets the requirements of the project subject to tender, and the main technical, economic and management personnel are of high quality and excellent performance, they will be graded as appropriate, with a maximum score of 3 points.

Construction organization design K3 (out of 42 points)

1, main construction method, 5-6 points;

2, the main materials and construction machinery and equipment, the main construction machinery plan, 4-5 points;

3, labor arrangement plan and labor subcontracting table, 4-5 points;

4, technical organization measures to ensure the engineering quality, 4-5 points;

5, technical organization measures to ensure safety in production, 4-5 points;

6, technical organization measures to ensure the construction period, 4-5 points;

7, technical organization measures to ensure civilized construction, 4-5 points;

8, construction schedule or construction network diagram and construction general layout, 5-6 points.

The judges shall explain the reasons for grading the above items.

Bidding period K4 (out of 3 points)

1, if the bidding time limit does not exceed the time limit specified in the tender documents, it is basically divided into 1. If the bidding time limit for a project exceeds 5% of the time limit for a project, it will be deemed that the tendering unit has not responded to the requirements of the bidding documents, and this item will get 0 point.

The time limit for a project proposed in the tender documents shall refer to the current national time limit quota.

2. If the bidding period is shorter than the construction period, 0. 1 min will be added for each shortening, and the maximum is 1 min.

3, there is a time limit for a project commitment, there is a breach of economic penalties as appropriate, the highest score is1; Otherwise, it is 0.

Project quality, civilized construction and safe production target K5 (full score: 3 points)

1. The project quality, civilized construction and safe production meet the relevant standards and requirements in the bidding documents, and the score is1; Do not meet the relevant standards and requirements in the tender documents, can not be used as a candidate for winning the bid.

2, project quality, civilized construction, production safety commitment, economic penalties for breach of contract as appropriate, the highest score is 2 points; Otherwise, it is 0.

Bid evaluation K6 (out of 2 points)

1, the physical bill of quantities, material and equipment unit price list, direct cost, indirect cost, profit, tax and fee list, site factor and construction measures cost list, total quotation list and other forms are complete and accurate, and the score is1; Otherwise, points will be deducted as appropriate.

2. If the quotation sheet of each single list is equal to the total quotation sheet and the total price of the bidding documents (10,000 yuan is the pricing unit, accurate to two decimal places, rounded to the third decimal place), score 0.5 point.

3. The bid documents have not been altered or inserted, or have been individually altered or inserted, but have been stamped with the bidder's amendment seal, 0.5 points.

If the bidder is informed criticism in two years due to illegal behaviors in engineering quality, civilized construction and safety production, points will be deducted as appropriate:

(1) is punished by informed criticism, the municipal construction administrative department, and 2 points will be deducted each time;

(2) by the municipal government, municipal construction law enforcement and supervision departments or provincial construction administrative departments.

Department informed criticism, punishment, 2.5 points each time;

(3) by the provincial government, the provincial construction engineering law enforcement and supervision departments or the the State Council municipal construction administrative departments.

Informed criticism, the competent department of punishment, deducted 3 points each time;

(4) The bidder attended the bidding meeting and received the bidding documents, but failed to attend on time without justifiable reasons.

Participate in the bid opening meeting and deduct 2 points in the bid evaluation of the next project subject to tender;

(5) The matters complained by bidders are investigated by relevant supervision, management, law enforcement and supervision departments.

Upon understanding, if it is found to be inaccurate, 2 points will be deducted in the bid evaluation of the next project subject to tender.

If one of the above points is punished by multi-level informed criticism, the points will be deducted according to the highest standard, and the accumulation will not be repeated.

(4) bid evaluation method

If the percentage system is adopted for bid evaluation, the bid evaluation shall be conducted according to the proportion of each evaluation index in the percentage system and its bid evaluation standard, and according to the bid evaluation method disclosed at the bidding meeting. After the bid opening, according to the bid evaluation procedure, the judges will score all bidders' bids according to the scoring criteria, and finally discharge the list of successful candidates according to the scores.

The comprehensive evaluation method and the lowest evaluated bid price method can also be used for bid evaluation.

(5) Bid evaluation statistics

The bid evaluation statistics shall be summarized by the bid evaluation committee and reviewed by the municipal garden construction management station. The scoring method is as follows: on the basis of the judges' scoring, remove a highest score and a lowest score respectively, and take the average of the remaining scores as the bidder's score.

If it is found that the judges fail to score according to the regulations, the person in charge of the municipal garden construction management station will make a ruling.

Third, calibration.

The calibration method shall be incorporated into the contents of the tender by the tenderer and announced at the tender meeting.

If public bidding is adopted, the bid evaluation committee shall recommend the bidder with the first score as the candidate for winning the bid in turn.

If inviting public bidding is adopted, the bid evaluation committee shall submit a written bid evaluation report to the tenderer after the bid evaluation, clarify the evaluation and comparison opinions of the bid evaluation committee on each bid document, and recommend no more than three qualified bid-winning candidates according to the bid evaluation method specified in the tender documents. The tenderer shall determine the winning bidder according to the written bid evaluation report put forward by the bid evaluation committee and the candidates recommended by the bid evaluation report. The way to determine the winning bidder must be specified in the tender documents.

The tenderer may also authorize the bid evaluation committee to directly determine the winning bidder.

Fourth, the issuance of the bid-winning notice

After the bid evaluation, the tenderer will submit the bid evaluation report and related materials to the municipal garden construction management station for the record. City Garden Construction Management Station has no objection within 5 days, and the tenderee may issue the Notice of Winning Bid.

Verb (short for verb) others

(1) The Municipal Bureau of Landscape Architecture shall be responsible for the interpretation of these Measures.

(2) These Measures shall come into force on June 6, 2004+10/October 6+May 6.
