What are the obligations between husband and wife?
(1) Both husband and wife have equal rights and obligations to bring up their children. Raising and educating children is an equal obligation and responsibility of both husband and wife. If minor children cause damage to others, both husband and wife shall bear the same economic compensation liability. Similarly, raising children is an equal right for both husband and wife, and neither party can refuse the other party to exercise their rights. Even if the husband and wife divorce, this obligation and right cannot be changed.
(2) Both husband and wife have the obligation to carry out family planning. Some people say that a basic principle of China's marriage law is that every citizen must abide by it, and both husband and wife should bear this obligation equally in the family. If this legal obligation is violated, both husband and wife should bear legal responsibilities equally.
(3) Both husband and wife have the obligation to support each other. Husband and wife are partners who live and die together. They should comfort each other spiritually and help each other financially. No matter whether one of the husband and wife needs support because of difficulties in life, the other party must fulfill the obligation of support.
(4) Husband and wife have equal rights to dispose of the same property, and any unauthorized disposition by either party has no legal effect.
(5) Husband and wife have the same obligation to pay off debts. Husband and wife debt refers to the debt owed by one spouse to the family during the existence of the husband-wife relationship, such as raising children and supporting the elderly.
Legal basis: Article 236 of the Criminal Law of People's Republic of China (PRC), whoever rapes a woman by violence, coercion or other means shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years.
