Second, the number of resettlement calculation
The number of land acquisition and resettlement personnel is calculated by dividing the number of cultivated land requisitioned before land acquisition by the average number of cultivated land occupied by each requisitioned unit. The registered permanent residence of the land-expropriated resettlement personnel was changed from agricultural registered permanent residence to non-agricultural registered permanent residence. The benchmark date for land requisition and resettlement is the time when the people's government at or above the provincial level approves the requisition of land.
Three, the use of land expropriation compensation fee
In the urban planning area, the basic living security system will be implemented for those who have reached the age of 18, and each person will withdraw 23,000 yuan (17,800 yuan resettlement subsidy and 5,200 yuan land compensation fee) from land acquisition compensation as the basic living security fee. The basic living security fee and the overall planning fee shall be uniformly collected by the Municipal Bureau of Land and Resources at the time of land acquisition, and shall be included in the special fund account for the basic living security of land-expropriated farmers, and the basic living security system for land-expropriated farmers shall be established. A one-time living allowance of 13000 yuan will be given to the land acquisition and resettlement personnel under the age of 8 who do not meet the basic living guarantee conditions. The remaining land acquisition compensation is managed and used by collective economic organizations in accordance with relevant laws, regulations and policies.
Fourth, the implementation of land resettlement
For multi-channel resettlement of landless farmers and villages around the town with more land acquisition, 5-7% of the total land actually developed and constructed in accordance with urban planning and land use according to law will be concentrated into pieces, and the village collective will be approved as resettlement land at one time. When the resettlement land is actually used, it shall go through the examination and approval procedures in accordance with the regulations.
Five, strictly regulate the order of land acquisition
In order to ensure the smooth progress of land acquisition and further standardize the order of land acquisition, land acquisition must be managed by the municipal land administrative department according to law and implemented by the municipal unified land acquisition agency. No unit, organization, group or individual may directly requisition collective land. Land administrative departments shall, in accordance with the procedures and contents stipulated by laws and regulations, requisition land according to law and give compensation, and the land-expropriated units shall not ask for additional compensation. After the compensation for land expropriation is in place according to the regulations, the rural collective economic organizations and farmers whose land has been expropriated shall not delay the delivery of the land.
Six, this notice shall come into force as of June, 2003 1 day+10/day, and the original document of Shanghai [1 999] 72 shall be suspended. This notice shall be interpreted by the Municipal Bureau of Land and Resources.
