Provisions on the Employment of Civil Servants (for Trial Implementation)
Chapter I General Principles
Article 1 In order to standardize the recruitment of civil servants and ensure the basic quality of newly recruited civil servants, these Provisions are formulated in accordance with the Civil Service Law.
Article 2 These Provisions shall apply to civil servants employed by organs at all levels who hold non-leadership positions below the chief clerk and other equivalent positions.
Article 3 The recruitment of civil servants shall adhere to the principles of openness, equality, competition and merit-based, and in accordance with the standard of having both ability and political integrity, the method of combining examination and investigation shall be implemented.
Article 4 The recruitment of civil servants must be within the prescribed staffing limit and there are corresponding job vacancies.
Article 5 The recruitment of civil servants shall be conducted in accordance with the following procedures:
Publish recruitment notices;
(2) Registration and qualification examination;
(3) examination;
(4) inspection and physical examination;
(five) publicity, approval or filing.
When necessary, the competent department of civil servants at or above the provincial level may adjust the above procedures.
The recruitment of civil servants in special positions can be simplified with the approval of the competent department of civil servants at or above the provincial level.
Article 6 When recruiting civil servants in ethnic autonomous areas, appropriate care should be given to ethnic minority applicants in accordance with laws and relevant regulations. The specific measures shall be determined by the competent department of civil servants at or above the provincial level.
Article 7 The competent departments of civil servants and recruitment agencies shall take measures to facilitate citizens to apply for the exam.
Chapter II Management Organization
Article 8 The central competent department of civil servants shall be responsible for the comprehensive management of the recruitment of civil servants throughout the country. Specifically including:
(a) Drafting regulations on the employment of civil servants;
(two) to formulate rules and policies for the recruitment of civil servants;
(three) to guide and supervise the recruitment of civil servants in local organs at all levels.
The central competent department of civil servants is responsible for organizing the recruitment of civil servants of the central organs and their directly affiliated institutions.
Article 9 The competent department of civil servants at the provincial level shall be responsible for the comprehensive management of the recruitment of civil servants in this region. Specifically including:
(a) to implement the laws, regulations, rules and policies of the state on the recruitment of civil servants;
(two) according to the Civil Service Law and these Provisions, formulate the implementation measures for the recruitment of civil servants within their respective jurisdictions;
(three) responsible for organizing the recruitment of civil servants at all levels within their respective jurisdictions;
(four) to guide and supervise the recruitment of civil servants at all levels below the municipal level;
(five) to undertake the relevant work entrusted by the central competent department of civil servants.
When necessary, the provincial competent department of civil servants may authorize the municipal competent department of civil servants with districts to organize the recruitment of civil servants within their respective jurisdictions.
Article 10 The competent departments of civil servants at all levels below the municipal level divided into districts shall be responsible for the recruitment of civil servants within their respective jurisdictions in accordance with the provisions of the competent departments of civil servants at the provincial level.
Article 11 The recruitment agency shall undertake the recruitment of civil servants according to the requirements of the competent department of civil servants.
Chapter III Employment Plan and Recruitment Announcement
Twelfth recruitment agencies according to the vacancy situation and job requirements, put forward recruitment positions, places and qualifications, and formulate employment plans.
Article 13 The employment plans of the central organs and their directly affiliated institutions shall be examined and approved by the central competent department of civil servants.
The employment plan of provincial organs and their directly affiliated institutions shall be examined and approved by the competent department of civil servants in the province. The application procedures and examination and approval authority of the employment plan of the organs below the municipal level with districts shall be stipulated by the provincial competent department of civil servants.
Article 14 The competent department of civil servants at or above the provincial level shall formulate the recruitment work plan according to the relevant laws, regulations, rules and policies.
When the municipal competent department of civil servants with districts is authorized to organize the recruitment of local civil servants, its recruitment work plan shall be reported to the provincial competent department of civil servants for examination and approval.
Article 15 The competent department of civil servants shall, according to the recruitment work plan, make a recruitment announcement and release it to the public. The recruitment announcement shall include the following contents:
(a) recruitment agencies, recruitment positions, places and qualifications;
(2) Registration method, time and place;
(3) Examining the application materials to be submitted;
(four) examination subjects, time and place;
(5) Other precautions.
Chapter IV Registration and Qualification Examination
Article 16 To apply for civil servants, the following conditions shall be met:
(1) Having China nationality;
(two) at least eighteen years of age and under thirty-five years of age;
(3) Supporting the Constitution of People's Republic of China (PRC);
(4) Having good conduct;
(5) Having the physical conditions to perform their duties normally;
(six) have the ability to meet the requirements of the post;
(7) Having a college degree or above;
(eight) the qualifications required by the competent department of civil servants at or above the provincial level;
(nine) other conditions stipulated by laws and regulations.
The conditions listed in items (2) and (7) of the preceding paragraph may be appropriately adjusted with the approval of the competent department of civil servants at or above the provincial level.
The competent departments of civil servants and recruitment agencies shall not set qualifications unrelated to job requirements.
Seventeenth the following persons shall not apply for civil servants:
(1) Having received criminal punishment for committing a crime;
(2) Being expelled from public office;
(three) there are other circumstances in which the law stipulates that it is not allowed to be employed as a civil servant.
Article 18 Applicants shall not apply for the positions listed in Article 68 of the Civil Service Law as civil servants of the recruitment agency.
Article 19 An applicant shall submit application materials to the recruitment agency, and the application materials submitted by the applicant shall be true and accurate.
The recruitment agency shall examine the application according to the qualification conditions and confirm whether the applicant is qualified for the examination within the specified time.
Chapter V Examination
Twentieth civil service recruitment examination is conducted by written examination and interview, and the examination content is set according to the basic ability and different job categories of civil servants.
Twenty-first written examination includes public subjects and professional subjects. Public * * * subjects are uniformly determined by the central competent department of civil servants. Professional subjects are set by the competent department of civil servants at or above the provincial level according to the needs.
Twenty-second after the written test, the recruitment agency in accordance with the provisions of the competent departments of civil servants at or above the provincial level, according to the written test results from high to low to determine the interview candidates.
The interview is organized and implemented by the competent department of civil servants at or above the provincial level, and can also be entrusted to the recruitment agency or the municipal competent department of civil servants with districts.
The contents and methods of the interview shall be stipulated by the competent department of civil servants at or above the provincial level.
Interview should form an interview examiner group. The interview examiner group is composed of personnel with interview examiner qualifications. The identification and management of the qualification of the interviewer shall be the responsibility of the competent department of civil servants at or above the provincial level.
Twenty-third civil servants who employ special positions may adopt other assessment methods with the approval of the competent department of civil servants at or above the provincial level.
Chapter VI Investigation and Physical Examination
Twenty-fourth recruitment agencies in accordance with the provisions of the competent departments of civil servants at or above the provincial level, according to the candidates' test scores from high to low order to determine the candidates, and to review and inspect their qualifications.
Twenty-fifth qualification examination mainly verifies whether the applicant meets the prescribed qualification conditions and confirms whether the information and materials submitted at the time of registration are true and accurate.
Article 26 The investigation contents mainly include the candidates' political thoughts, moral quality, ability and quality, study and work performance, law-abiding, honesty and self-discipline, and whether they need to be avoided.
An investigation team shall be formed, consisting of more than two people. The investigation team shall listen to opinions extensively, be comprehensive, objective and fair, and truthfully write investigation materials.
Twenty-seventh physical examination shall be organized by the competent department of civil servants at or above the municipal level and implemented by the recruitment agency.
The items and standards of physical examination shall be implemented in accordance with the unified provisions of the state.
Physical examination shall be carried out in medical institutions designated by the competent department of civil servants at or above the municipal level. After the physical examination is completed, the chief physician shall review and sign the results of the physical examination, and the medical institution shall affix its official seal.
If the recruiting agency or applicants have doubts about the results of the medical examination, they may submit a re-examination in accordance with the regulations. When necessary, the competent department of civil servants at or above the municipal level with districts may require the physical examination object to be re-examined.
Chapter VII Publicity, Approval or Filing
Twenty-eighth recruitment agencies according to the candidates' examination results, inspection and physical examination results, merit-based list of candidates to be hired, announced to the public.
The publicity time is seven days. The publicity content includes the name of the recruitment agency, the name of the person to be hired, gender, admission ticket number, graduation institution or work unit, supervision telephone number and other matters stipulated by the competent department of civil servants at or above the provincial level.
After the expiration of the publicity period, if there is no problem or the problems reflected do not affect the employment, the examination and approval or filing procedures shall be handled according to the prescribed procedures; If there are serious problems and there is evidence, they will not be hired; If there are serious problems in the report, but it is difficult to verify for a while, the employment will be suspended, and then whether to hire will be decided after verification and conclusion.
Twenty-ninth central authorities and their directly affiliated institutions to hire personnel list submitted to the central civil service department for the record; The list of persons to be hired by local recruitment agencies at all levels shall be submitted to the provincial or municipal civil service authorities for examination and approval.
Article 30 The probation period for newly recruited civil servants is one year. During the probation period, the recruitment agency will inspect the newly hired civil servants and arrange necessary training. Those who have completed the probation period will be appointed; If the probation period is unqualified, the employment will be cancelled. If the central organ cancels the employment, it shall report to the central civil servant department for the record. The examination and approval authority for the cancellation of employment by local authorities at all levels shall be stipulated by the provincial civil service department.
Chapter VIII Discipline and Supervision
Article 31 The recruitment of civil servants shall be subject to supervision. The competent department of civil servants and the recruitment agency shall promptly accept the report and handle it according to the management authority.
Thirty-second personnel engaged in recruitment work should be avoided under any of the circumstances listed in Article 70 of the Civil Service Law.
Thirty-third in any of the following circumstances, the competent department of civil servants at or above the provincial level or the municipal competent department of civil servants with districts shall order it to make corrections or declare it invalid according to the situation; Those who bear the leadership responsibility and direct responsibility shall be criticized and educated, removed from the employment post or punished according to the seriousness of the case; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
(a) not according to the provisions of the quota and job requirements;
(2) Failing to employ in accordance with the prescribed conditions and procedures;
(three) unauthorized introduction, unauthorized change of employment policy, resulting in adverse effects;
(four) in the recruitment work, the circumstances are serious.
Article 34 If a civil servant is under any of the following circumstances, the competent department of civil servants or the unit to which he belongs shall, depending on the seriousness of the case, give him criticism and education, be transferred from his employment post or be punished; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
Leaking problems and other secret information;
(2) Taking advantage of work convenience to forge examination results or other relevant materials for recruitment;
(3) Assisting candidates to cheat in exams by taking advantage of their work convenience;
(four) due to dereliction of duty, resulting in the re recruitment work;
(five) other acts in violation of employment discipline.
Thirty-fifth candidates who violate the employment discipline shall be criticized and educated according to the seriousness of the case, and their qualifications for examination, inspection and physical examination shall be cancelled, and they shall not be employed or their qualifications for employment shall be cancelled. Among them, those who commit fraud and other serious violations of employment discipline are not allowed to apply for civil servants within five years. If a crime is constituted, criminal responsibility shall be investigated according to law.
Chapter IX Supplementary Provisions
Thirty-sixth organs (units) managed by referring to the Civil Service Law employ staff other than ground staff, and these Provisions shall apply.
Thirty-seventh the funds needed for the recruitment of civil servants should be included in the financial budget and guaranteed.
Article 38 The Organization Department and Personnel Department of the CPC Central Committee shall be responsible for the interpretation of these Provisions.
Article 39 These Provisions shall come into force as of the date of promulgation. Interim Provisions on the Employment of State Civil Servants (Lu Renfa [1994] 1No.) and Measures for the Employment of People's Police in Public Security Organs (Ren Fa [1996) issued on June 7th.
