How to apply for a post-doctoral work visa in the United States

To apply for a work visa of H 1B, American postdoctoral fellows need to find an American employer first, and then the American employer submits an application and obtains the approval of USCIS before applying for a work visa.

Step 1:

Find an American employer who is willing to hire you and sign an employment contract.

Step two:

Employers apply to the Ministry of Labor for approval (petition), and special occupations need to apply for LCA.

Step 3:

Employers should submit Form I- 129 to the US Citizenship and Immigration Service, and attach an application or LCA approved by the Department of Labor.

Step 4:

After approval of Form I- 129:

-employees outside the United States: apply for H- 1B visa through American consulates overseas. In addition, if they get a visa, they must also apply for an entry permit from the US Customs and Border Protection when entering the country.

-Employees in the United States: submit an application to the US Immigration Service, including the original signed approval letter for applying for labor, all application forms signed by the employer, the application letter signed by the employer, and the certification materials required by the above employers and employees.

Step five:

Document delivery and lottery procedures.

Immigration only accepts applications received on or after April 1, so pay special attention to the delivery time. Generally, the lottery starts in mid-April. If lots are drawn, employers and lawyers will receive the receipt of I-797 case from USCIS at the end of April or early May, with the case number on it, which can be used to inquire about the progress of the case. If you don't win the lottery, the immigration office will return the application package one after another.

Step 6:

The general immigration bureau will give a reply within three to six months after receiving the lottery application. If the application is for Premium Processing Service, the Immigration Bureau will make a decision within 15 days after the receipt of I-797 is issued. If the Immigration Bureau requests supplementary materials (evidence is required), the urgent case will be decided within 15 days after receiving the supplementary materials.
