Paragraph 4 of Article 25 of the Measures for the Administration of Real Estate Appraisal Institutions stipulates: "A real estate appraisal institution that has obtained Grade III qualification within a temporary period may engage in real estate appraisal business other than company listing, enterprise liquidation, judicial appraisal, house expropriation and mortgage of projects under construction." Therefore, in addition to the three-level provisional qualification, real estate appraisal institutions with other qualifications can engage in housing expropriation and evaluation.
Assess the number of participating institutions
In principle, the house expropriation project is assessed by the real estate price assessment agency. However, for projects with a large scope of collection, housing purposes can be divided into blocks or differentiated, and more than two real estate appraisal agencies will undertake the evaluation work. In the latter case, the lead evaluation company should be determined, and unified standards should be formulated for the selection of evaluation basis, evaluation method and important parameters.
Selection procedure of evaluation institutions
Usually, the house expropriation department first organizes the expropriated person to negotiate and choose the real estate price appraisal agency. If negotiation fails, the evaluation agency shall be selected by voting, majority decision, lottery, lottery and other random methods. During the negotiation, if all the expropriated persons reach an agreement with the lessee of public housing, they shall submit written materials to the housing expropriation department indicating the selected real estate price appraisal institution and signed or sealed by all the expropriated persons. If no agreement is reached within the negotiation period, the house expropriation department shall organize a vote according to the principle that the minority is subordinate to the majority. If it is still impossible to vote, it will be determined by random methods such as drawing lots and shaking numbers.
Selection of evaluation institutions in different places in judicial procedure
In some places, there may be cases where the expropriated person simply doesn't know how to evaluate the company's formation process. And some expropriated people may refuse to evaluate. However, once such expropriated people are made a compensation decision, ordered to hand over their land, or their houses are illegally demolished, judicial evaluation will generally involve specific litigation of the right to relief. It is worth noting that the evaluation institutions in the judicial evaluation procedure can be selected not only from local evaluation institutions, but also from evaluation institutions in different places, which is more conducive to ensuring the independence, objectivity and rationality of judicial evaluation.
