Article 10 of the government procurement law
First of all, government procurement should buy domestic goods, projects and services. Except in any of the following circumstances:
(a) The goods, projects or services to be purchased cannot be obtained in China or on reasonable commercial terms;
(2) Purchased for use outside China;
(3) Other laws and administrative regulations provide otherwise.
The definition of domestic goods, projects and services mentioned in the preceding paragraph shall be implemented in accordance with the relevant provisions of the State Council.
Two, twenty-second suppliers to participate in government procurement activities shall meet the following conditions:
(1) Having the ability to bear civil liability independently;
(2) Having a good business reputation and a sound financial accounting system;
(3) Having the necessary equipment and professional technical ability to perform the contract;
(4) Having a good record of paying taxes and social security funds according to law;
(five) in the three years before participating in government procurement activities, there is no major illegal record in business activities;
(6) Other conditions stipulated by laws and administrative regulations.
The procurement subjects in government procurement activities include state organs, institutions and organizations at all levels.
State organs refer to organs at all levels that enjoy the administrative power entrusted by the state according to law, have independent legal personality and use the state budget as funds for independent activities. Institutions refer to social service organizations organized by state organs or other organizations with the purpose of social welfare and engaged in education, science and technology, culture, health and other activities; Group organization refers to a non-profit social organization formed voluntarily by China citizens in order to achieve the consent of their members and to carry out activities in accordance with their articles of association.
If the purchaser uses all or part of the financial funds for procurement, it belongs to the scope of government procurement management. Financial funds include budgetary funds, extra-budgetary funds and government funds. Loans repaid with fiscal funds shall be regarded as fiscal funds.
