Guidelines for the pilot reform of separation of bidding and evaluation of housing construction and municipal infrastructure projects in Jiangmen City

In order to implement the Guiding Opinions of the Ministry of Housing and Urban-Rural Development on Further Strengthening the Bidding Supervision of Housing Construction and Municipal Infrastructure Projects (Regulation [20 19] 1 1No.) and the work arrangement of the Municipal Party Committee and Municipal Government on expanding the pilot scope of the reform of bid evaluation separation of housing construction and municipal infrastructure projects in our city, and to implement the bidder responsibility system to standardize the behavior and rights of bidders, To prevent the risk of clean government, realize the goal of unifying the rights and responsibilities of tenderers and selecting the best among the bidding projects, and combine the task requirements of Notice of Jiangmen Municipal People's Government Office on Printing and Distributing the Action Plan for the High-quality Development of Jiangmen Industrial Chain (Fu Jiang Office [202 1] 19), these guidelines are formulated.

A, the tenderer responsibility system.

The tenderer shall be responsible for the bidding activities of the project that separates bid evaluation according to law. The tenderee decides to start the tender independently, establishes the tender supervision group, the bid evaluation committee and the calibration committee independently, formulates the shortlisting selection method, the bid evaluation method and the calibration method, and is responsible for the bidding process and results. The tenderer shall consciously consolidate the main responsibilities of all parties in the bidding activities, and prohibit any unit or individual from illegally interfering in the bidding activities in any way.

Second, set up a bidding supervision team.

(1) Number and composition of personnel

The tenderer shall set up a supervision team of three or more persons before issuing the tender announcement. Personnel can be directly appointed by the tenderer, or supplemented by the superior management unit, project owner and other units of the tenderer, and a supervision team leader is determined to be responsible for overall supervision.

(2) Group responsibility

1. The supervision team shall supervise the whole bidding process, but shall not express opinions on the substantive contents involved in qualification examination or shortlisting, bid evaluation and calibration, nor participate in the discussions of the bid evaluation committee and calibration committee. Special circumstances lead to the inability to continue the bid opening, shortlisting, bid evaluation or bid selection, and the relevant personnel who violate the procedures and disciplines still refuse to correct after being pointed out, as well as other violations of relevant regulations found in the bidding activities, the bidding supervision team shall truthfully record and report to the main person in charge of the tenderee unit and the administrative supervision department in time.

2. The bidding supervision team is responsible for preparing the supervision report of this project subject to tender, and submit it to the administrative supervision department of project bidding at the same time as submitting the written report of bidding. The contents of the supervision report include the basic situation of the project subject to tender, the description of the bidding process, whether the members of the calibration committee have calibrated according to the calibration method, the list of members of the supervision team, their positions and contact information, records of abnormal situations and treatment measures during the bidding process, etc.

(3) supervision methods

1. The bidding supervision team shall supervise the tenderee to formulate the screening method and calibration method in advance before issuing the tender announcement, clarify the selection criteria and calibration factors for screening and calibration, and file them for future reference.

2. The bidding supervision team shall supervise the bidding activities through on-site supervision, and all bidding parties shall consciously accept supervision and inspection.

Third, determine the bid evaluation and calibration scheme

The tenderer shall, according to the actual situation of the project, fully consider the project construction quality, construction period, investment and related special requirements, and formulate corresponding bid evaluation scheme and calibration scheme according to the principle of combining bid selection, so as to achieve the best bidding effect.

(A) the formulation of the bid evaluation plan

1. Bid evaluation method. The bid evaluation method shall be subject to quantitative evaluation, and the bid evaluation committee shall evaluate, compare and score according to the methods specified in the tender documents, and recommend candidates for calibration.

The lowest bid price method, effective range average method, average method and other price competition methods are adopted for construction bidding projects, and the specific methods are specified by the tenderer in the bidding documents. The tender documents shall specify the treatment methods when the bidders offer the same price, which affects the determination of the winning candidate.

Design and construction general contracting, engineering services and other bidding projects adopt comprehensive evaluation method, with objective evaluation as the main and subjective evaluation as the supplement. The bid evaluation committee will evaluate, compare and grade the bidding documents according to the bid evaluation criteria specified in the bidding documents, and recommend the candidates for calibration. When the comprehensive evaluation method is adopted, the tenderer shall prepare the bid evaluation criteria according to the actual situation of the project. The evaluation criteria should include technology, economy (bid quotation) and credit (business). The total credit score shall not be higher than 40% of the total score, and the bid quotation score shall not be lower than 20% of the total score.

2. Recommend calibration candidates. The bid evaluation committee shall evaluate the bidders in accordance with the bid evaluation sequence and criteria determined in the tender documents. According to the ranking of bidders' bid evaluation scores from high to low, the top 3-5 candidates are recommended to enter the calibration procedure, and the specific number should be specified in the tender documents in advance. Because different evaluation criteria are adopted in bid evaluation and calibration, bid evaluation scores and rankings will not be used as reference factors for subsequent calibration, nor will they be pushed to the calibration committee.

(2) Formulation of calibration scheme

The tenderer shall, according to the characteristics of the project, reasonably select quantitative bid evaluation and calibration, voting and other methods to determine the winning candidates and their rankings, and the number of winning candidates shall not exceed 3. It is suggested that the quantitative bid evaluation and calibration method should be given priority to projects with bidding control price of 40 million yuan or more.

1. Quantitative evaluation and calibration methods. Quantitative evaluation calibration method is a method to determine the winning candidate and its ranking through quantitative evaluation of calibration candidates. The selection committee compares and scores the selection candidates according to the selection factors specified in the tender documents (see Annex 1) and the scoring rules (which are formulated by the tenderer as the internal control mechanism of the tenderer), and ranks the selection candidates according to the total score. If the calibration candidates have the same score, they should be ranked according to the total score after removing the highest score and the lowest score.

2. The voting method is determined. The voting method is a method to determine and rank the successful candidates through preferential voting. The selection committee evaluates and compares the selection candidates according to the selection criteria specified in the tender documents (see Annex 2), and determines the ranking of the selection candidates by voting.

3. Other calibration methods that comply with laws and regulations.

Fourth, the screening process

(1) When the number of formal bidders is less than or equal to 15, all of them will be shortlisted for the bid evaluation procedure.

(2) When the number of formal bidders exceeds 15, select 15 formal bidders for bid evaluation procedure with reference to the credit priority shortlisting method in the Application Guide of Credit Evaluation Information for Housing Construction and Municipal Infrastructure Projects in Jiangmen City. At the same time, in order to fully implement the tenderer's responsibility system and realize the tenderer's merit-based demand, the tenderer may set up a recommendation shortlisting committee to recommend no more than five formal bidders to directly enter the bid evaluation process by voting, except for the shortlisted 15 formal bidders. The recommended short-listed bidders have at least Grade B and above qualifications in the credit management information system of construction enterprises in our city, and priority is given to leading enterprises and seed multiplication enterprises with strong comprehensive strength and performance ability. Whether to choose the voting method for recommending the finalists and the corresponding rules shall be stipulated in advance by the tenderer in the tender documents. For projects recommended by voting, the number of members of the recommended shortlisted committee shall be an odd number of more than 5, and the composition of the members shall refer to the requirements for the establishment of the selection committee.

(3) In principle, the bid opening procedure and the screening procedure should be conducted on the same day.

Verb (abbreviation of verb) bid evaluation procedure

(A) the formation of the bid evaluation committee

The bid evaluation shall be the responsibility of the bid evaluation committee established by the tenderer according to law. The bid evaluation committee is composed of representatives of the tenderee and technical and economic experts, with an odd number of more than five, among whom the technical and economic experts other than the tenderee and the tendering agency shall not be less than two thirds of the total members. The tenderer may give priority to the selection of bid evaluation experts who have implemented or tried out the bid evaluation separation method from the provincial expert database, so that the bid evaluation committee can implement the bid evaluation separation method more accurately, fairly and reasonably, and ensure the smooth progress of the bid evaluation procedure.

(2) Qualification examination

The bid evaluation committee shall conduct evaluation according to the qualification examination elements specified in the tender documents, including but not limited to business license, safety production license, qualification grade, bid bond, project leader, information of the person who has broken the trust, etc. The conclusion of qualification examination is divided into two grades: qualified or unqualified. Any qualification examination element is unqualified, and the qualification examination conclusion is unqualified. The examination conclusions of the qualification examination elements are all qualified, and the qualification examination conclusions shall not be deemed unqualified for other reasons.

(3) Detailed review

1. The bid evaluation committee will evaluate and score the bid price according to the bid evaluation method in the bidding documents.

2. The bid evaluation committee shall evaluate and score according to the bid evaluation method of credit (business) standard in the bidding documents, and in combination with the enterprise qualification, credit evaluation, similar project performance, award-winning and other information provided by the credit (business) part of the bidding documents and the commitment clauses in the bidding contract.

3. The bid evaluation committee shall independently evaluate and score the technical part of the bid documents in accordance with the technical bid evaluation methods in the bidding documents.

(four) to determine the calibration candidates

After detailed review, the bid evaluation committee will summarize the scores of the bid evaluation experts on the same bidder respectively, and recommend the top 3-5 bidders to the tenderee as the selection candidates according to the method specified in the tender documents, and the list of selection candidates will not be sorted.

(5) Bid evaluation report

After the bid evaluation is completed, the bid evaluation committee shall submit a written bid evaluation report to the tenderer.

Intransitive verb calibration program

(1) Investigation before calibration

The tenderee may inspect the candidate for calibration and the person in charge of the proposed project before the calibration, and the inspection process shall be supervised by the bidding supervision team. After investigation, if the bid performance and awards used by the successful candidate are fraudulent, or there are major changes in the operating and financial conditions or illegal acts, which may affect their performance ability, the tenderer shall truthfully record them and submit them to the bid evaluation committee for future reference.

(2) Establish a calibration committee.

The tenderer establishes a bid evaluation committee, and the legal representative of the tenderer is the first responsible person. The formation process shall be witnessed by the bidding supervision team and filed by the tenderee for future reference. Members of the bid evaluation committee shall not concurrently serve as members of the selection committee.

The members of the Selection Committee are odd numbers of more than 5 persons, which are generated in principle from the tenderee, the project owner or the employing unit and its subordinate institutions; If necessary, some experts can also be randomly selected from the provincial expert database. The tenderee of financial capital investment projects can choose from the superior and subordinate project departments of this system, and the tenderee of non-financial state-owned capital investment projects can choose from their parent companies and subsidiaries. Members of the Selection Committee are required to be middle-level and above managers (leading cadres with engineering experience are preferred), or have intermediate or above titles in engineering and economics, or have registered professional qualification certificates in engineering and economics.

(3) Hold a calibration meeting

In principle, the bid evaluation meeting will be held in the local public resource trading center within 2 working days after the bid evaluation. If the tenderer needs to investigate or solicit opinions from the bid evaluation candidates or the person in charge of the proposed project, it shall be held within 10 working days from the end of bid evaluation.

The selection committee recommended the selection team leader at the selection meeting. If the legal representative or principal responsible person of the tenderer participates in the bid evaluation committee, he shall directly serve as the bid evaluation team leader.

The tenderer may introduce the project at the bid evaluation meeting, and members of the bid evaluation committee may ask questions to the tenderer.

The bid evaluation committee shall, among the bid evaluation candidates recommended by the bid evaluation committee, determine no more than three successful candidates in accordance with the bid evaluation method specified in the tender documents, and indicate the ranking.

(four) the successful candidate publicity

The tenderer shall, within 3 days after the end of the bidding meeting, publicize the winning candidate on the website of Guangdong Bidding Supervision Network and Jiangmen Public Resource Trading Center for 3 days. The publicity content shall conform to the Administrative Provisions of Guangdong Provincial Housing and Urban-Rural Development Reform Commission on Information Disclosure in the Whole Bidding Process of Housing Construction and Municipal Infrastructure Projects (Guangdong Jianbiao [2018] No.6).

(five) to determine the winning bidder

After the expiration of the publicity period of the winning candidate, the tenderer shall determine the winning candidate ranked first as the winning bidder. If the first successful candidate abandons the bid, fails to perform the contract due to force majeure, fails to submit the performance bond according to the requirements of the tender documents, or is found to have illegal acts affecting the result of winning the bid, which does not meet the conditions for winning the bid, the tenderer may determine other successful candidates in turn according to the list of successful candidates, reorganize the bid, or re-bid, and the specific details shall be specified in the tender documents.

(six) submit a written report

Within 15 days from the date of issuance of the bid-winning notice, the tenderer shall submit a written report on the bidding situation to the administrative supervision department of project bidding and tendering.

VII. Handling of Objections and Complaints

Objections and complaints about project bidding activities should be handled in strict accordance with the relevant laws and regulations on bidding and the Measures for Handling Complaints about Construction Project Bidding Activities.

When handling objections and complaints, the tenderer may organize the original bid evaluation committee and the bid evaluation committee or re-establish them to review the contents of the objections and complaints.

Eight, the tenderer's internal control mechanism

The tenderer shall, in accordance with the national laws, regulations and rules, and in combination with the specific characteristics and difficulties of the project, formulate a feasible bid evaluation separation scheme to achieve the best bidding effect. The legal representative or principal responsible person of the tenderee shall be responsible for the management and supervision of the calibration process.

(A) decision-making constraint mechanism

The methods of qualification examination, screening, bid evaluation, calibration and the formation of calibration committee are included in the decision-making mechanism of "three majors and one big" and the scope of credit assessment. Those that do not fall within the decision-making scope of "three majors and one big" shall go through the examination and approval procedures according to the management system.

(B) Avoidance mechanism

Members of the supervision team, members of the recommendation shortlisted committee, members of the bid evaluation committee and members of the bid selection committee who have a direct interest in the bidder shall voluntarily withdraw, and shall explain the reasons for withdrawal in writing.

(C) the whole process of "leaving marks" mechanism

The tenderer shall record and video the whole process of bid opening, bid evaluation and bid selection, and the relevant materials shall be used as engineering technical files for future reference. The tenderee shall properly keep relevant information and shall not forge, alter or conceal it.

Nine, bidding effect evaluation mechanism

During the implementation of the project, the tenderer shall track and evaluate the performance of the winning bidder. The start time of bid evaluation shall be decided by the tenderer, and shall not exceed one year after the end of the bidding work in principle. The evaluation contents may include: whether the bid commitment is fulfilled, the arrival of project management personnel, construction period, quality and safety management, change and cost control, coordination and service, etc. After the completion of bid evaluation, a bid evaluation report should be written to evaluate the bidding effect and optimize the subsequent calibration method. The administrative supervision department may inspect the bid evaluation report, and if there are illegal or irregular problems in the bidding activities, it will deal with them according to law, and inform the superior competent department and discipline inspection and supervision department of the tenderer of the relevant situation.

These Guidelines shall come into force on June 5, 2022, and shall be valid for three years. "Jiangmen City Housing and Urban-Rural Development Bureau issued; Notice (Jian Jiang [2020]113) shall be abolished at the same time.

Quantitative evaluation of calibration factors

The tenderee can choose technology, price, enterprise strength, economic and social contribution, bad information, etc. according to the actual situation of the project. As a calibration factor.

First, technical factors can include quality standards, quality objectives, schedule objectives, safe and civilized construction objectives, main management and technical personnel input, etc. ; Goods related to engineering construction may include technical specifications, technical parameters, service standards, delivery or implementation time and place that must be responded to within the scope of technical target evaluation.

Second, the price factors are ranked from low to high according to the candidate quotation for calibration.

Three, enterprise strength factors can include qualification grade, enterprise credit, asset-liability ratio, industry status, past performance (including performance impact, difficulty, award), performance, etc.

Four, the economic and social contribution factors can include the unified output value and growth rate of enterprises in recent years, tax payment, driving the development of construction industry.

Five, bad information evaluation factors, including all kinds of punishment and bad behavior records made by the administrative department, the construction unit's bad behavior records, performance evaluation records and other records of dishonesty.

The bidder shall formulate quantitative scoring rules around the above-mentioned calibration factors, so that the calibration committee can evaluate the calibration candidates during the calibration process.

Selection criteria of air ticket determination method

Second, bidders who make great contributions to the economy and society and drive the development of the construction industry are better than those who make small contributions and drive the development.

3. Bidders with good performance records have priority over bidders with poor performance records or no performance records.

7. Bidders who have won more authoritative honors at all levels are better than those who have won less honors, and they have priority in winning awards issued by various industry authorities and industry associations at all levels.

Eight, the bidder with good financial status is superior to the bidder with average financial status.

9. Bidders with no bad behavior records are better than those with bad behavior records, and bidders with lighter bad behavior records are better than those with heavier bad behavior records.
